Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting a correction to the awards listed on his DD Form 214, specifically, that his Korean Service Medal with one battle star be changed to reflect four battle stars. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 18 December 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken. Documentary material considered by the Board consisted of Petitioner’s application together with all material submitted in support thereof, relevant portions of Petitioner’s naval record, and applicable statutes, regulations, and policies, to include the 25 July 2018 guidance from the Under Secretary of Defense for Personnel and Readiness regarding equity, injustice or clemency determinations (Wilkie Memo). 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner enlisted in the Marine Corps Reserves and began a period of active duty on 24 October 1950. On 17 December 1951, he was discharged with an honorable characterization of service. d. In his Petition, the Petitioner states that his DD Form 214 is incorrect in that it does not reflect his campaign stars for his participation on the . e. On 17 December 1951, the Petitioner was issued a DD Form 214 reflecting he was entitled to the Korean Service Medal with one bronze star. f. On 16 March 2004 and 14 September 2011, the Petitioner was issued a Transmittal of and/or Entitlement to Awards report by the Navy Personnel Command (NPC) documenting Petitioner’s authorized awards. The 2004 report notes multiple awards to include the Korean Service Medal with four bronze stars. The 2011 report notes Petitioner is entitled to the Combat Action Ribbon. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an error warranting relief. RECOMMENDATION In view of the above, the Board directs the following corrective action: Petitioner’s naval record be corrected by issuing him a DD Form 215, indicating he is entitled to the following awards as noted on the16 March 2004 and 14 September 2011 Transmittal of and/or Entitlement to Awards reports issued by NPC: World War II Victory Medal National Defense Service Medal Korean Service Medal with four bronze stars United Nations Service Medal Presidential Unit Citation Ribbon Combat Action Ribbon Honorable Service Lapel Pin (Rupture Duck) Discharge Button Presidential Unit Citation (Foreign) Republic of Korea Republic of Korea War Service Medal That no further action be granted. A copy of this report of proceedings be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
