After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 25 May 2021. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. You requested to correct the record to reflect being commissioned in the U.S. Navy and would like to receive the salary you would have earned had you completed 20-years of active duty service. The Board, in its review of relevant portions of your naval record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that your claims of error or injustice were not substantiated. A review of your record indicates you enlisted in the U.S. Naval Reserve on 18 July 1968 for a term of 6-years, and discharged/released on 6 November 1968 for immediate enlistment in U.S. Navy on 7 November 1968 for a term of 4-years. On 17 July 1969 you were discharged to accept a commission as a Reserve officer in the U.S. Navy. On 18 July 1969 you signed NAVPERS 962, Appointment as Reserve Officer in United States Navy accepting your appointment as a Reserve Officer in the grade of Ensign/O-1 and received follow on orders indicating your Reserve status. Unfortunately, you were not selected for permanent appointment in the Regular Navy by the board that convened on 20 March 1972 and due to force reduction you were notified of your impending transfer to the Standby Reserve-Inactive effective 1 October 1975. Subsequently, you were honorably discharged from the U.S. Naval Reserve on 6 August 1982. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
