Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner signed her Officer Appointment Acceptance and Oath of Office on the date of graduation from medical school. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 1 September 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 26 May 2015, Petitioner signed a NAVPERS 1000/4 (Officer Appointment Acceptance and Oath of Office) appointing her an Ensign in the inactive U.S. Navy Reserve with a date of rank of 4 May 2015. c. On 23 June 2015, Petitioner signed a NAVCRUIT 1131/131 (Armed Forces Health Professions Scholarship Program (AFHPSP) Medical Students, Dental Students, and Medical Service Corps Students (1975X, 1985X, and 1995X) Service agreement. d. On 5 April 2019, an entry grade credit worksheet was completed based upon a thorough administrative and professional review of all the documents submitted with the application for appointment, 4 years of entry grade credit was recommended and a grade of Lieutenant. e. On 17 May 2019, Petitioner graduated from Science Center and was awarded a degree of Doctor of Medicine. f. On 12 June 2019, Petitioner signed a NAVPERS 1000/4 (Officer Appointment Acceptance and Oath of Office) appointing her a Lieutenant in the active U.S. Navy with a date of rank of 19 May 2019. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that in the summer of 2019, Medical Corps Interns encountered significant challenges in the strength gain process, which resulted in delays in receipt of military pay and benefits including concerns with reimbursement of travel claims due to incorrect date on the Oaths of Office. The Board further concluded that Officer Appointment Acceptance and Oath of Office should have been signed by Petitioner on the same day she graduated from Medical school. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner signed her NAVPERS 1000/4 (Officer Appointment Acceptance and Oath of Office) on “17 May 2019” vice “12 June 2019”. Note: Date of graduation and date of rank do not match therefore review for possible date of rank adjustment. Note: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances effective 17 May 2019. Furthermore, Petitioner is advised to submit any unsettled travel claim and all receipts to her local personnel support detachment (PSD) along with a copy of this Board for Correction of Naval Records (BCNR) decision letter. Finally, Petitioner is advised to contact her local personnel property office (PPO) for reimbursement of a Do It Yourself (DITY) move, if applicable.
