Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to establish entitlement to Enlistment Bonus for High School (EBHS), Enlistment Bonus for Shipping (EBSHP) and Enlistment Bonus for Source Rate (EBSR). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 20 April 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, she exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Reference (b), outlined the enlistment bonus eligibility for future active component Sailors initially classified or reclassified on or after 1 February 2019 through 9 May 2019. Eligibility criteria for EBHS, EBSHP and EBSR was as follows: EBHS -active component recruits had to be classified as a high school senior in the Navy from 1 August 2018 through 30 September 2018; EBSHP -AV-5YO recruits were required to ship between February and May of Fiscal Year (FY) 2019; and EBSR -AV-5YO recruits had to ship between October and September of any FY. b. On 19 February 2019, Petitioner enlisted in the U.S. Naval Reserve for a term of 8 years. NAVCRUIT 1133/52, Enlistment Guarantees – Annex “A” list Aviation Electronic, Electrical, & Computer Systems Technician (AV/5YO) Program Guarantee (T+X), Enlistment Bonus for RTC PFA (EBPFA) -$2,000 Bonus, Enlistment Bonus for Shipping (EBSHP) -$10,000 Bonus and Enlistment Bonus for Source Rate (EBSR) -$10,000 Bonus. c. On 19 February 2019, Petitioner signed NAVCRUIT 1133/102, Enlistment Bonus (EB) Statement of Understanding (SOU) that indicated eligibility for $10,000 EBSR, $10,000 EBSHP and $2,000 EBPFA. Petitioner signed the EB SOU on 22 July 2019 indicating no changes to enlistment program/rating or accession date. d. Petitioner’s Active Duty Service Date is 22 July 2019. e. Petitioner completed Recruit Basic Military Training on 21 September 2019. f. Petitioner completed Avionics Technician 1 Level Class on 20 February 2020. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants partial favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the basic eligibility criteria to receive an EBSR but did not meet the requirements to garner an EBHS or EBSHP in accordance with reference (b). Although the proper administrative requirements were not completed, the Board felt that under these circumstances, partial relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s NAVCRUIT 1133/52, Enlistment Guarantees – Annex “A” to DD Form 4 dated 19 February 2019 is modified to reflect Option 3: “Enlistment Bonus Source Rate (EBSR) ­$10,000 Bonus” vice “Enlistment Bonus for Shipping (EBSHP) -$10,000 Bonus” and Option 4: “N/A” vice “Enlistment Bonus for Source Rate (EBSR) -$10,000 – Bonus”. This change will entitle Petitioner to $10,000 EBSR upon graduation from “A” school. The part of Petitioner’s request for corrective action that exceeds the foregoing is denied. Petitioner enlistment and shipment date was subsequent to the authorized periods for EBHS or EBSHP outlined in reference (b). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
