Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to show Petitioner received Selective Reenlistment Bonus (SRB) upon graduating from school. 2. The Board consisting of reviewed Petitioner’s allegations of error and injustice on 9 February 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b) [30 January 2007], Obligated Service to Train (OTT). A member who is not eligible for an SRB in their present rating/skill or who does not hold an SRB eligible NEC may qualify for an SRB if they convert to, or train for, an SRB eligible rating/NEC/skill. The member must agree to obligate service to train for the SRB rating/NEC/skill and then reenlist after the new rating/NEC/skill is attained or rating conversion is completed. The new rating/NEC/skill must be designated for award of an SRB at the time of the agreement to obligate service to train. Furthermore, an SRB may be paid to a member for that specialty upon completion of qualification training and reenlistment in the specialty and at the award level in effect at the time of the agreement or at the award level in effect at reenlistment, whichever is higher. c. On 20 July 2010, Petitioner entered active duty. d. On 8 May 2015, Petitioner reenlisted for 3 years with an end of active obligated service (EAOS) of 7 May 2018. e. In accordance with reference (c) [22 December 2017], this NAVADMIN announces revised Selective Reenlistment Bonus (SRB) award levels and reenlistment policy for Active Component and Full-Time Support (FTS), and supersedes reference (a). Changes to navy enlisted classifications (NEC) as a result of the new NEC construct are reflected throughout this NAVADMIN. As a reference, both legacy and new NECs are listed below to show SRB eligible ratings/skills. Legacy NECs are annotated in this NAVADMIN as LNEC and new NECs are annotated as NNEC. Commands should check the Navy Personnel Command (NPC) website listed in paragraph 3 for updates as new NECs are released. Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Finally, a zone “B” SRB with an award level of 2.0 ($30,000 award ceiling) for the HM/8708 (L35A) rate/NEC was authorized. f. On 4 January 2018, Petitioner was issued official change duty orders (BUPERS order: 0048) to Pensacola, FL for duty under instruction with required obligated service to April 2024. g. On 16 February 2018, Petitioner reenlisted for 6 years with an end of active obligated service (EAOS) of 15 February 2024. h. On 2 March 2018, Petitioner signed an agreement to extend enlistment for 2 months with a soft end of active obligated service (SEAOS) of 15 April 2024 in order to incur sufficient obligated service to execute BUPERS order: 0048. i. On 14 March 2018, Petitioner transferred from duty station, and arrived to Pensacola, FL for duty under instruction on 30 March 2018. Petitioner was scheduled to graduate on 1 June 2020. j. In accordance with reference (d) [2 December 2019], This NAVADMIN announces revised selective reenlistment bonus (SRB) award levels and reenlistment policy for Active Component (AC) and Full-Time Support (FTS), updates to the pay for performance pilot (a Sailor 2025 initiative) and changes to how future SRB award levels will be announced. SRB award levels and reenlistment policy listed in this NAVADMIN supersede those contained in reference (a). Additionally, it expands the pay for performance pilot program, a Sailor 2025 initiative designed to better reward our top Sailors, where eligible Sailors can receive an additional 0.5 multiple or *kicker* in their SRB multiple if they meet specific criteria outlined in paragraph 6. Finally, all future SRB award level updates, to include the addition and closure of skills, will be published on the SRB website as opposed to being published via NAVADMIN. This change is part of a concerted effort to increase the agility of the SRB program by publishing updates more frequently. Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Finally, a zone “B” SRB with an award level of 4.0 ($30,000 award ceiling) for the HM/8708 (L35A) rate/NEC was authorized. k. On 6 May 2020, Petitioner graduated from Dental Hygienist course. l. On 31 August 2020, Petitioner transferred, and arrived to on 23 September 2020 for duty. m. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that at the time of the issuance of BUPERS order: 0048, NAVADMIN 311/17 authorized an SRB for NEC 8708 (L35A). Petitioner's EAOS date was 7 May 2018. The anticipated graduation date from HM Dental Hygienist "C" School was 1 June 2020. The purpose of OTT program is to allow members that are training in a SRB rate/NEC to obtain sufficient OBLISERV to complete the program. Since petitioner's EAOS of 7 May 2018 was before the graduation date of 1 June 2020, Petitioner was eligible for OTT and would have reenlisted upon receiving the NEC. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The 6-year immediate reenlistment contract (NAVPERS 1070/601) executed on 16 February 2018, is null and void. The agreement to extend enlistment (NAVPERS 1070/621) executed on 2 March 2018 was for a term of 25 months vice 2 months. Petitioner executed on 2 March 2018 an Administrative Remarks (NAVPERS 1070/613); fulfilling a 46 month agreement to extend enlistment operative on 8 June 2020. This will satisfy Petitioner’s obligated service requirement of BUPERS order: 0048. Petitioner was discharged on 5 May 2020 and reenlisted on 6 May 2020 for a term of 4 years. Note: This change will entitle the member to a zone “B” SRB with an award level of 4.0 ($30,000 dollar award ceiling) for the HM/8708 (L35A) rate/NEC. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
