Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to receive basic allowance for housing (BAH) based on dependents location for the period of 9 December 2019 through 3 March 2020. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 17 December 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 4 September 2019, while permanently assigned to SSN Petitioner marries dependent spouse in . The dependent spouse’s residence is located in . b. Petitioner’s Master Military Pay Account (MMPA) reflects Family Separation Housing Overseas (FSH-O) allowance effective 4 September 2019, however, BAH at with dependent rate was not initiated. c. Petitioner’s MMPA reflects Family Separation Allowance (FSA) effective 10 September 2019. d. Petitioner’s MMPA reflects FSH-O stopped effective 30 October 2019. e. Petitioner transferred from SSN effective 16 November 2019. Petitioner’s MMPA reflects FSA along with overseas cost of living allowance (OCOLA) and FSA stopped effective 15 November 2019. f. On 9 December 2019 Petitioner joined for duty with Petitioner’s MMPA reflects BAH at the without dependent rate for PDS zip code 98315 effective this date. g. On 25 December 2019 Petitioner’s dependent child is born in and is in the care of Grossmont Pediatrics. h. On 7 January 2020 MMPA entry adjusting Petitioner’s BAH to the with dependent rate PDS zip code 98314 effective 9 December 2019. i. On 12 February 2020 Grossmont Pediatrics provides memo stating dependent child in their care since 25 December 2019 is not cleared for travel until 1 March 2020. j. On 11 March 2020 approving official signs Petitioner’s DD Form 1351-2 with indication dependent travel from was completed on 4 March 2020. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded per reference (b), Petitioner is entitled to BAH at with dependent rate and FSA effective 4 September 2019, therefore, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner authorize to receive Basic Allowance for Housing (BAH) at with dependent rate for dependent location zip code effective 4 September 2019 through 3 March 2020. Petitioner credited Family Separation Allowance (FSA) from date of marriage 4 September 2019 per reference (2) (Table 27-1, rule 9) through 9 September 2019. Note: Petitioner will resumes to receive BAH at with dependent rate at the PDS zip code effective 4 March 2020. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
