Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her record be corrected by removing the initial fitness report covering the period 2 September 2017 to 31 October 2017 from her official military personnel file (OMPF) and replacing it with the corrected fitness report, signed by Petitioner on 4 June 2018, and correcting her performance summary report (PSR) to reflect the corrected fitness report data. 2. The Board reviewed Petitioner’s allegations of error and injustice on 24 November 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. PERS-32 received the original fitness report for the period of 2 September 2017 to 31 October 2017, enclosure (2). Petitioner’s reporting senior (RS) submitted a fitness report letter-supplement, enclosure (3), dated 5 February 2019 and a revised fitness report for the same period, making changes to the original report. PERS-32 placed the letter-supplement and revised fitness report in Petitioner’s OMPF on 21 March 2019. Both fitness reports are currently in Petitioner’s OMPF. Petitioner contends that the initial fitness report has her ranked in the wrong summary group and is missing her command at sea recommendation; moreover, the corrected fitness report data is not reflected in her PSR. Petitioner argues that due to these errors her record could be briefed incorrectly to selection and promotion boards, resulting in being non-selected for command at sea and promotion and negatively impacting her future career progression within the Naval Service. c. Enclosure (4), an advisory opinion (AO) furnished by Navy Personnel Command (PERS-32), recommended Petitioner’s request be denied, due to the fact that reference (b) does not require removal of the original fitness report. CONCLUSION Upon review and consideration of all the evidence of record, the Board determined that Petitioner’s request warrants relief. In this regard, the Board noted that Petitioner and her command attempted to correct her record properly; however, significant information is not reflected in her PSR which could unjustly affect Petitioner’s promotion and selection for command at sea. The Board thus concluded that Petitioner’s initial fitness report shall be removed from her OMPF and her PSR entry shall be updated to reflect the corrected (supplemental) fitness report data. RECOMMENDATION In view of the above, the Board recommends the following corrective action: Remove Petitioner’s initial fitness report dated 2 September 2017 to 31 October 2017 and Letter Supplement from her OMPF naval record. Update Petitioner’s Performance Summary Report to reflect data from the corrected fitness report and remove any indication that supplemental material is in her record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
