Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received Selective Retention Bonus (SRB). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 4 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 9 August 2010, Petitioner entered active duty. c. On 4 November 2014, Petitioner reenlisted for 4 years with an ECC of 3 November 2018. d. On 26 May 2016, Petitioner signed an agreement to extend enlistment for 22 months with an EAS of 3 September 2020 in order to obligate service for assignment to BRC class 5-17. Furthermore, Petitioner extended and additional 21 months with an EAS of 3 June 2022. e. On 1 October 2018, Petitioner was promoted to Staff Sergeant/E-6. f. On 29 June 2019, Petitioner was joined by for School . g. In accordance with reference (b) [26 September 2019], this bulletin announces a change to reference (A), the SRB program and the BSSRB program authorized for FY20. FY 20 Marines who hold the PMOSs of 2874 and 2862 or reenlist with 2874 or 2862 as an IMOS will now rate SRB amounts as described below in sections 3.a and 3.b. Furthermore, a zone “B” SRB for MOS 2862, which is capped at $14,000 for 48 months of additional obligated service was authorized. h. On 30 October 2019, Petitioner’s Careerist Active Duty Reenlistment was submitted. i. On 21 November 2019, Petitioner was issued Marine Corps Basic Order. j. On 9 January 2020, Petitioner’s Careerist Active Duty Reenlistment was approved by HQMC. k. On 23 January 2020, Petitioner reenlisted for 4 years with an ECC of 23 January 2024. l. On 11 March 2020, Petitioner was issued modification Marine Corps Basic Order with the following: I. Direct and transfer Marine to proceed and report not later than 1 July 2020 and report not earlier than 1 June 2020 to , for duty in BMOS 2862. The standard tour of duty for this assignment is 36 months. Prior to transfer SNM must have sufficient obligated service to complete assigned tour length. m. On 7 June 2020, Petitioner transferred to MEF for duty. n. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that at the time Petitioner’s Careerist Active Duty Reenlistment was submitted, Petitioner was in school to earn PMOS 2862. In accordance with reference (b), Petitioner was eligible for an SRB for PMOS 2862 at the completion of his training; however the command did not submit a request for the SRB. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The enlistment/reenlistment document (DD Form 4) executed on 23 January 2020 was for a term of 4 years and 8 months, vice 4 years. Furthermore, 8b (Remarks) listed REENLISTED FOR THE FOLLOWING INCENTIVE(S): “PMOS 2862 ZONE B SRBP $14,000. I UNDERSTAND THAT THIS REENLISTMENT CONTRACT IS CONTIGENT UPON MY SUCCESFUL COMPLETION OF THE TRANING REQUIREMENTS OF MOS 2862” vice “NONE”. Note: This change upon completion of MOS training will entitle the member to a zone “B” SRB for MOS 2862, which is capped at $14,000 for 48 months of additional obligated service. Remaining obligated service to 3 September 2020 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
