Pursuant to the provisions of references (a), Petitioner, a former Navy Sailor, filed enclosure (1) with this Board requesting a change to his naval record, specifically, to correct his middle name from “ ” to “ ” to reflect the correct spelling of his birth name and to correct his date of birth from , to. Enclosures (1) and (2) apply. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 16 June 2020, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner enlisted in the Navy and began a period of active duty on 27 October 1972. Petitioner was discharged on 21 October 1976, with an honorable characterization of service. d. At the time of his discharge, Petitioner’s Report of Separation from Active Duty (DD Form 214) reflects his name as ”and a date of birth of “.” e. Petitioner requests that his DD Form 214 be changed to correct two clerical errors, specifically that his middle name be corrected to and that his date of birth be changed to . Petitioner provided a copy of his birth certificate in support of his request. CONCLUSION: The Board considered that Petitioner’s request and reviewed the document he submitted in support of the request to address the clerical changes to his middle name and date of birth on his DD Form 214. The Board found that Petitioner’s Report of Separation, as issued upon his discharge, should be corrected to reflect the name and the date of birth of . In view of the above, the Board directs the following corrective action: RECOMMENDATION: That Petitioner be issued a Correction to DD Form 214, Certificate of Release or Discharge from Active Duty ( DD Form 215) reflecting the name and the date of birth of . That no further changes be made to the record. That a copy of this report of proceedings be filed in Petitioner’s naval record. That upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received on 12 May 2020. 4.
