Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to reflect date of rank as 23 May 2017 due to Entry Grade Credit (EGC) adjustment. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 21 January 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner’s NAVCRUIT 1070/3, Medical Corps Entry Grade Credit Worksheet dated 23 May 2019 and signed by Senior Member, Medical Corps Professional Review Board (PRB) reflects credit given in item 5 as 0-years, 11-months, and 25-days and item 6 as 1-year, 0-months, and 0-days for total service credit of 9-years, 11-months, and 25-days. b. On 11 September 2019, Petitioner’s NAVCRUIT 1131/245, Memorandum of Understanding for Initial Date of Rank was signed and reflected block b as 09-year, 11-months, and 25-days, and block e (Official Date of Rank) as 190528. c. On 11 September 2019, Petitioner signed NAVPERS 1000/4, Officer Appointment Acceptance and Oath of Office with blocks 19 and 21 (Permanent Grade/Present Grade Date) reflecting 20190528. d. On 3 February 2020, Senior Member, Medical Corps PRB provided an email to Navy Recruiting Command regarding Petitioner’s EGC and indicated “…a segment of his experience as a practicing MD/DO (item 5) was inadvertently overlooked as there was experience practicing before and after his fellowship training (item 6). As noted on EGCW, experience a practicing MD/DO has maximum value of three years”. e. On 8 February 2020, Petitioner issued a new NAVCRUIT 1131/245, Memorandum of Understanding for Initial Date of Rank updating block b as 12-years, 00-months, and 00-days and block e (Official Date of Rank) as 170523. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the eligibility criteria for EGC in accordance with reference (b). However, because of administrative oversight, Petitioner’s complete MD/DO experience was not properly considered by the Medical Corps PRB; therefore, under these circumstances, the Board felt relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s NAVCRUIT 1070/3, Medical Corps Entry Grade Credit Worksheet is amended to reflect credit given in Item 5 as “3-years, 0-months, and 0-days” vice “0-years, 11-months, and 25-days” and Total Service Credit (15 Years Maximum) as “12-years, 0-months and 0-days” vice “9-years, 11-months and 25-days”. Petitioner’s NAVPERS 1000/4, Officer Appointment Acceptance and Oath of Officer effective 11 September 2019 is amended to reflect: Block 19 (Permanent Grade Date) as “23 May 2017” vice “28 May 2019” and Block 21 (Present Grade Date) as “23 May 2017” vice “28 May 2019”. Note: Defense Finance and Accounting Service will complete an audit of Petitioner’s pay records to determine Petitioner’s difference in pay and allowances entitlement. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
