Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to transfer Enlistment Bonus for Shipping (EBSHP) into his Enlistment Bonus for Source Rate (EBSR). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 22 December 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner’s College certified transcript indicate 56 hours completed as of 28 March 2019. b. On 7 May 2019, Petitioner enlisted in the U.S. Naval Reserve for a term of 8-years. Petitioner was issued NAVCRUIT 1133/52, Enlistment Guarantees – Annex “A” that included Nuclear Field (NF 6YO) Program, Enlistment Bonus for RTC (PFA) (EBPFA) - $2,000 Bonus, Enlistment Bonus for Source Rate (EBSR) - $35,000 Bonus and Enlistment Bonus for College Credit (EBCC) - $3,000 and Active Duty Service Date (ADSD) of 4 November 2019. c. On 24 July 2019, Petitioner was reclassified and issued NAVCRUIT 1133/52, Enlistment Guarantees – Annex “B” that listed Nuclear Field (NF 6YO) Program, EBPFA - $2,000 Bonus, EBSHP - $15,000 Bonus, EBSR - $20,000, EBCC - $3,000 and ADSD changed to 19 August 2019. d. On 19 August 2019, Petitioner signed NAVPERS 1070/621, Agreement to Extend Enlistment for a term of 24-months for training in the Nuclear Field. e. Petitioner’s Active Duty Service Date is 19 August 2019. f. Petitoner completed Recruit Basic Military Training on 19 October 2019. g. Petitioner completed Nuclear Field Class “A” School on 8 June 2020. h. Petitoner completed Nuclear Power school on 30 October 2020. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. In accordance with reference (b), Petitioner met the criteria to be eligible for EBSR - $34,000, EBPFA - $2,000 and EBCC - $4,000 upon reclassification; however, EBSHP was not offered for the NF rating. Although the proper administrative requirements were not completed, the Board felt that Petitioner’s Enlistment Guarantees render him eligible for enlistment bonuses up to $40,000; therefore, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's NAVCRUIT 1133/52, Enlistment Guarantee - Annex "B" to DD Form 4 dated 7 May 20119 is amended to reflect: Nuclear Field (NF 6YO) Program, Enlistment Bonus for Source Rate (EBSR) - $34,000 vice $20,000, Enlistment Bonus for RTC (PFA) (EBPFA) - $2,000, and Enlistment Bonus for College Credit (EBCC) - $4,000 vice $3,000. Note: EBSR amount is reduced from $38,000 to $34,000 to meet the enlistment bonus $40,000 cap in accordance with reference (b). This change will entitle Petitioner to $2,000 EBPFA and $4,000 EBCC upon graduation from Recruit Training Command. $34,000 EBSR is payable upon graduation from Nuclear Power school. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy.
