After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 17 August 2021. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations, and policies. In addition, the Board considered the advisory opinion contained in Naval Personnel Command 1430 PERS 8021/083 of 9 March 2021; a copy of which was previously provided to you for comment. You requested accelerated advancement to E-4 effective 20 April 2016 and retroactive pay and allowances. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that you did not meet the criteria for retroactive accelerated advancement to E-4 in accordance with Military Personnel Manual (MILPERSMAN) Articles 1510-030 and 1220-010. Specifically, MILPERSMAN 1510-030 stipulates three criterions for accelerated advancement; complete all advancement in rate requirements; performance appraisal review; and receive Commanding Officer’s recommendation. MILPERSMAN 1220-010 outlines the Aircrew Program requirements and specifies the schools required to include earning the appropriate Navy Enlisted Classification (NEC) to garner accelerated advancement to E-4. A review of your record indicates you entered active duty on 4 May 2015 and signed NAVPERS 1070/621, Agreement to Extend for a term of 24-months. By signing the agreement to extend, you acknowledged the prerequisites for accelerated advancement to E-4. You completed Naval Aircrewman Candidate School on 17 August 2015, Aviation Rescue Swimmer School on 6 November 2015, and Fleet Replacement Aircrewman Course on 27 December 2017. Thereafter, you earned the G34A NEC effective 1 January 2018 and subsequently advanced to E-4 effective 19 January 2018. In this connection, the Board concurred with the comments contained in the advisory opinion. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
