Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to require issuance of Certificate of Release or Discharge from Active Duty (DD Form 214) for active duty service from 7 November 2016 to 4 February 2017. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 22 December 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner issued modification of active duty special work orders on 26 September 2016 by Commander, Navy Personnel Command message 260628Z Sep 16. Period of active duty 6 November 2016 through 4 February 2017. Petitioner to depart place from which called (or ordered) to active duty (PLEAD) no earlier than 6 November 2016. b. According with Petitioner’s Master Military Pay Account (MMPA), basic pay starts effective 6 November 2016. c. According with Petitioner’s orders contain a reporting endorsement effective 7 November 2016. Petitioner’s electronic service record contains a joined date effective 7 November 2016. d. On 4 February 2017 Petitioner’s active duty pay stops. Petitioner’s orders contain detaching endorsement effective this date. e. On 5 March 2020 Petitioner receives letter from Navy Personnel Command-312 denying his request for a DD Form 214. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board determined the Petitioner was on active duty for ninety-one days from 6 November 2016 through 4 February 2017. The Board concluded per reference (b) issuance of a DD Form 214 is required and relief warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner issued DD Form 214 for period of active duty from 6 November 2016 through 4 February 2017 with distribution as required by Navy directives. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
