After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 5 January 2021. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. You requested to establish entitlement to Montgomery GI Bill – Selected Reserve (MGIB-SR) education benefits. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. The Board concluded that you do not meet the eligibility criteria for MGIB-SR in accordance with Department of Defense Instruction 1322.17. Specifically, this policy outlines the basis eligibility criteria as enlisting, reenlisting or extending an enlistment in a Reserve Component for service in the Selected Reserve (SELRES) for 6-years and completion of DD Form 2384-1, Notice of Basic Eligibility (NOBE). Inactive service does not count toward the 6-year requirement. Additionally, the policy stipulates the period of entitlement for MGIB-SR will end on the day the Service member separates from SELRES. A review of your record reflects you enlisted under the New Accession Training program on 1 May 2012 with an active duty service date of 7 January 2013; 1 May 2012 through 6 January 2013 is inactive service. After completion of initial active duty training on 7 August 2013, you reported to Navy Operational Support Center, New York and served in a SELRES status until transferring to the Individual Ready Reserve effective 12 June 2018 through 30 April 2020, thereby rendering you ineligible for MGIB-SR education benefits. Moreover, there is no record of you completing DD Form 2384-1, Notice of Basic Eligibility (NOBE). You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
