Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received Special Duty Assignments Pay (SDAP) for the period of 5 December 2017 to 15 May 2018. 2. The Board, consisting of Ms. , Mr. , and Mr. , reviewed Petitioner’s allegations of error and injustice on 3 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), Special Duty Assignment Pay (SDAP) is awarded to Service members for the performance of duty in an assignment, location, or unit designated, where the assigned duties are determined to be extremely demanding, involving an unusual degree of responsibility or difficulty, or requiring special qualifications. c. In March 2013, Petitioner earned NEC G34A (MH-60S Multi-Mission Helicopter Aircrewman). d. On 20 November 2017, Petitioner’s SDAP level SD-3 at the rate of $225.00 per month was stopped effective 17 November 2017 (Petitioner transferred from duty station). e. On 5 December 2017, Petitioner arrived to Naval Aviation Warfighting Development Center (NAWDC) for duty. f. On 28 March 2019, Petitioner’s SDAP was started effective 15 May 2018 at SDAP level SD-3 at the rate of $225.00 per month, and stopped on 9 July 2021. g. On 9 July 2021, Petitioner transferred. h. On 23 July 2021, Commander, notified Director, Personnel Support Detachment that Petitioner was entitled to SDAP for level SD-3 ($225), and was qualified to perform in a Special Duty Billet (NEC G34A) effective from 5 December 2017 to 31 May 2018. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner was receiving SDAP at his prior command and although he was qualified to perform in a Special Duty Billet (NEC G34A) when he reported to his new command on 5 December 2017, he did not begin receiving the special pay. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was entitled to SDAP while assigned as MH-60S Multi-Mission Helicopter Aircrewman (NEC G34A), onboard , from 5 December 2017 to 14 May 2018, at SDAP level SD-3 at the rate of $225.00 per month. Note: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
