Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected by removing an Evaluation (EVAL) Report for the period 16 June 2019 to 7 April 2020 from his official military personnel file (OMPF). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 23 April 2021, and pursuant to its regulations, determined the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, found as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. Petitioner contends enclosure (2), a detachment EVAL for the period 16 June 2019 to 7 April 2020, should be removed because he was extended onboard and did not detach from his command, USon 7 April 2020. c. On 16 June 2020, Petitioner was issued enclosure (3), a periodic EVAL for the period 16 June 2019 to 15 June 2020. On 14 July 2020, his periodic EVAL at enclosure (3) was extended. Enclosure (4), the EVAL report extension letter, reflects Petitioner’s detachment from the command on 14 July 2020 by marking block 11 (detachment of individual) and changing blocks 14 and 15 to read “19JUN15 – 20JUL14” vice “19JUN16 – 20JUN15.” d. The Advisory Opinion (AO) at enclosure (5) confirmed Petitioner did not detach from his command on 7 April 2020. Further, the AO concluded enclosure (2) was in error and did not object to its removal “upon receipt of the next scheduled report or supplemental material from the reporting senior or directive from BCNR.” CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an error and injustice warranting relief. The Board concluded enclosure (2) is in error because Petitioner did not detach from the command on 7 April 2020. Further, the Board noted enclosure (3), the next scheduled report, has been uploaded to Petitioner’s OMPF. Relying upon the AO and its review of Petitioner’s current OMPF, the Board determined enclosure (2) should be removed from Petitioner’s OMPF. Additionally, the Board noted an error on enclosure (4) at paragraph 2b. The command changed block 14 to read “19JUN15” but the correct entry should be “19JUN16.” RECOMMENDATION In view of the above, the Board recommends the following corrective action. Petitioner’s naval record be corrected by removing enclosure (2), the EVAL for the reporting period 16 June 2019 to 7 April 2020. Petitioner’s naval record be corrected by modifying paragraph 2b of enclosure (4) to read “19JUN16” vice “19JUN15.” Any material or entries inconsistent with or relating to the Board's recommendation be corrected, removed or completely expunged from Petitioner’s record and that no such entries or material be added to the record in the future. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
