Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to show Petitioner was eligible for and received a Fiscal Year 2016 (FY16) Selective Retention Bonus (SRB). 2. The Board, consisting of Mr. , Ms. , and Mr. , reviewed Petitioner’s allegations of error and injustice on 1 July 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 24 September 2012, Petitioner entered active duty for 4 years with an ECC of 23 September 2016. c. On 1 September 2014, Petitioner was promoted to Corporal/E-4 with a PMOS of 0481. d. In accordance with reference (b), this bulletin announces the SRB program authorized for FY16 and the suspension of the FY16 BSSRB program. First term Marines (zone A) who reenlist on or after 1 July 2015 are eligible for the FY16 SRB program. Career marines (zone B and C) who reenlist on or after 1 July 2015 are eligible for the FY16 SRB program. This will include any regular component first term or career marine with an end of current contract (ECC) from 1 October 2015 to 30 September 2016. Zone A applies to those active component marines with 17 months to 6 years of active military service. First term marines with exactly 6 years of active military service on the date of reenlistment may be paid a zone A bonus if they have not previously received a zone A bonus. If they have received a zone A bonus, or if no zone A bonus is designated, they may be paid a zone B bonus. SRB payments are limited to one payment per zone. Zone A lateral move SRB payments are only authorized for those MOS(s) designated with lm. zone A SRB payments for marines who reenlist for at least 48 months obligated service are authorized as follows (bonuses for marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.f). Furthermore, a zone “A” SRB for MOS 0211 LM E-4, which is capped at $51,000 for 48 months of additional obligated service, was authorized. e. On 7 March 2016, Petitioner signed a Reenlistment Extension Lateral Move (RELM) request for 5 years and received an SRB, and was approved by cognizant authority on 28 June 2016. f. In accordance with reference (C) [10 June 2016], to inform Commanding Officers, Sergeants Major, Career Planners, and Marines of required changes to the FY16 SRB Program in order to support continuing force shaping efforts. Per references (b) and (c), the FY16 SRB program will be terminated 30 days after the release of this MARADMIN. Marines with an ECC during FY16 will no longer be eligible for a SRB. A FY16 ECC is defined as any Marine who has an ECC on the date of reenlistment between 1 October 2015 and 30 September 2016. g. On 6 July 2016, Petitioner’s first Term Active Duty Lateral Move was submitted, and was approved by HQMC on 18 July 2016. h. On 23 July 2016, Petitioner reenlisted for 5 years with an ECC of 22 July 2021. i. On 28 July 2017, Petitioner successfully completed the instruction and requirements for the Counterintelligence/Human Intelligence Course. j. On 4 December 2019, Petitioner signed an agreement to extend enlistment for 7 months with an EAS of 22 February 2021 in order to gain the obligated service required to execute PCS orders. k. On 3 February 2021, Petitioner reenlisted for 3 years and 6 months with an ECC of 2 August 2024. l. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner’s 1st Term Active Duty Lateral Move was submitted in a timely manner; however, due to processing time and no fault of Petitioner, FY16 SRB program terminated 30 days after the release of MARADMIN 294/16. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The Petitioner was discharged and reenlisted on 8/9 July 2016, vice on 22/23 July 2016 for a term of 5 years and 3 months vice 5 years. Note: This change upon completion of MOS training will entitle the member to a zone “A” SRB for MOS 0211LM, which is capped at $51,100 for 48 months of additional obligated service. Remaining obligated service to 23 September 2016 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
