Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected by removing an Administrative Remarks (page 11) 6105 counseling of 12 April 2017, enclosure (2), from her official military personnel file (OMPF). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 18 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, found as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. Petitioner received enclosure (2), a page 11, for failing the Physical Fitness Test (PFT) on 11 April 2017. Petitioner submitted a rebuttal to her page 11 on 18 April 2017. c. Petitioner argues the page 11 is unjust and should be removed because she suffered a miscarriage shortly before the PFT but was erroneously told that she would still have to conduct the test. With her request, Petitioner included medical records documenting her emergency room visit and subsequent treatment for the miscarriage. CONCLUSION Upon review and consideration of all the evidence of record, the Board determined that Petitioner’s request warrants relief. The Board noted that Petitioner informed her command of her medical issue in a timely manner and refuted the page 11 stating similar information as provided in this request. The Board found the page 11 unjust as Petitioner experienced a recent medical event, a miscarriage, which affected her ability to perform the PFT. The Board thus concluded that Petitioner’s page 11 entry, enclosure (2), shall be removed. RECOMMENDATION In view of the above, the Board recommends the following corrective action. Petitioner’s naval record be corrected by removing enclosure (2), her 12 April 2017 Page 11 6105 counseling entry. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
