Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to show Petitioner extended under the Obligate to Train (OTT) option, reenlisted for 6 years, and received a Selective Reenlistment Bonus (SRB). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 8 April 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b) [30 June 2007], a member who is not eligible for an SRB in their present rating/skill or who does not hold an SRB eligible NEC may qualify for an SRB if they convert to, or train for, an SRB eligible rating/NEC/skill. The member must agree to obligate service to train for the SRB rating/NEC/skill and then reenlist after the new rating/NEC/skill is attained or rating conversion is completed. The new rating/NEC/skill must be designated for award of an SRB at the time of the agreement to obligate service to train. c. On 21 April 2015, Petitioner entered active duty with an end of active obligated service (EAOS) of 20 April 2019. d. On 16 December 2017, Petitioner was advanced to Petty Officer Third Class/E-4. e. In accordance with reference (c) [14 May 2018], this NAVADMIN announces revised Selective Reenlistment Bonus (SRB) award levels and reenlistment policy for Active Component (AC) and Full-Time Support (FTS), and supersedes reference (a). Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Reenlistment requests for the following SRB award levels will be approved based on quota availability. SRB reenlistment requests for FTS are currently not being accepted. SRB reenlistment requests for AC must be submitted to Community Management Support Branch (BUPERS-328) via Officer Personnel Information System (OPINS) or Navy Standard Integrated Personnel System (NSIPS) 35 to 120 days in advance of the requested reenlistment date for the Sailor. Sailors must reenlist within 180 days of their EAOS, except in the following cases: “…Sailors who must OBLISERV to execute a permanent change of station (PCS) move will be allowed to reenlist early any time within one calendar year of the detachment month, but not later than the date of detachment from the last intermediate duty station…” Finally, a zone “A” SRB with an award level of 2.5 (45,000 dollar award ceiling) for the AG/J00A rate/NEC. f. On 17 October 2018, Petitioner signed a NAVPERS 1306/7 (Enlisted Personnel Action Request) requesting a seat for Aerographer's mate CL school. Furthermore, she had completed all prerequisite requirements and agree to meet OBLISERVE requirements prior to her transfer. On 22 October 2018, Petitioner’s request was approved by cognizant authority. g. On 21 November 2018, Petitioner was issued with official change duty orders ( ) from to with a required obligated service of July 2022. h. On 26 December 2018, Petitioner’s agreement to extend enlistment was submitted and became effective on 27 December 2018 for 39 months. i. On 9 January 2019, Petitioner transferred. Petitioner was in a temporary duty status from 12 January 2019 to 20 September 2019, and completed the Aerographers Mate Class C1 (390P) course, and earning NEC J00A. j. In accordance with reference (d) [11 June 2019], this NAVADMIN announces revised Selective Reenlistment Bonus (SRB) award levels and reenlistment policy for Active Component (AC) and Full-Time Support (FTS), superseding reference (a). Furthermore, no SRB for a zone “A” SRB for the AG/J00A rate/NEC was authorized. k. On 19 September 2019, Petitioner reenlisted for 4 years. l. On 20 September 2019, Petitioner transferred, and arrived to her new duty station on 28 October 2019. m. On 16 June 2020, Petitioner was advanced to Petty Officer Second Class/E-5. n. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner was issued orders with an obligated service to July 2022. Since petitioner's EAOS of 20 April 2019 was before the anticipated graduation date of 22 August 2019, Petitioner was eligible for OTT and could have reenlisted upon receiving the NEC, and she would have received an SRB. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner executed an agreement to extend enlistment (NAVPERS 1070/621) operative on 21 April 2019 for a term of 5 months vice 39 months under the OTT option. The immediate reenlistment contract (NAVPERS 1070/601) executed on 19 September 2019 is for a term of 6 years, vice 4 years. Note: This change will entitle the member to a zone “A” SRB with an award level of 2.5 (45,000 dollar award ceiling) for the AG/J00A rate/NEC. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
