Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish Petitioner’s credit for Basic Allowance for Housing (BAH) at the with dependent rate at zip code from 1 June 2019 to 29 August 2019. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 25 February 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Per reference (b), ordinarily a housing allowance is based on the Service member’s PDS, or the home port for a Service member assigned to a ship or afloat unit. However, the Service may determine that a Service member’s assignment to a PDS, or the circumstances of that assignment, requires a dependent to reside separately. Authorization or approval of a housing allowance based on the dependent’s location or old PDS is through the Service Secretary or through the Secretarial Process. b. On 28 March 2016 Petitioner joined for duty with 94 Cyber Protection Team CPT, and BAH at with dependent rate for PDS zip code begins. c. On 30 September 2018 Petitioner issued BUPERS ORDER 2478, change of duty orders. Petitioner to detach during April 2019 and report no later than 10 May 2019 to , . d. On 5 April 2019 Petitioner transferred from CPT and joined for temporary duty (TEMDU) with Commander effective 17 April 2019. Petitioner’s dependents remain in the (Privatized Housing) located in . e. On 19 April 2019 Petitioner transferred from TEMDU and Petitioner’s BAH at the with dependent rate for PDS zip code () stops. Deduction for privatized housing located in continues. f. On 20 April 2019 Petitioner is joined for duty with , . g. On 23 August 2019 Petitioner authorized family members non-concurrent travel to . h. On 29 August 2019 Petitioner’s family vacates (privatize housing) located in and depart for effective 30 August 2019. i. On 30 August 2019 Petitioner assigned military family housing by the Housing Services Center. j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Board concluded Petitioner entitled to BAH due to dependents authorized delayed travel and remained in Government Privatize Housing warranting relief. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner family members’ non-concurrent travel to Japan approved on 4 April 2019 vice 23 August 2019. Petitioner continues to be authorized BAH based on the old PDS zip code from 19 April 2019 (date BAH stopped) through 29 August 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
