After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your applications on 10 June 2021. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your applications, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies, as well as the 16 September 2020 Advisory Opinion provided by the Navy Personnel Command Enlisted Career Progression Branch (PERS-803) (the AO), as well as your rebuttal. The Board carefully considered your request to grant the convening of a Special Selection Board for promotion to the vacant E-9 quota for the gas turbine system technician (GS) rating for Fiscal Year (FY) 2021. The Board considered your contentions that the GS Rating for Master Chief (MC) was erroneously excluded from consideration at the FY 2021 Promotion Selection Board. You assert that according to monthly community health quad charts, the GSCM shows an open billet, although there is no GSMC currently serving in the Navy Reserve. The Board, however, substantially concurred with the AO, noting that [FY 2021] Reserve E-9 advancement quotas were generated by BUPERS-3 and OPNAV N13, and were approved by the Commander, Navy Personnel on 27 February 2020. The Board determined that the Navy’s failure to consider you for advancement to GSMC was due to a lack of approved quotas, and not due to an error or injustice in your official military personnel file. Moreover the Board concluded that determining Reserve GSMC advancement quotas is not under the Board’s purview. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
