Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received a Selective Reenlistment Bonus (SRB). 2. The Board reviewed Petitioner’s allegations of error and injustice on 22 April 2021, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of her naval service records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 20 July 2006, Petitioner entered active duty. See enclosure (2). c. On 29 October 2018, Petitioner was issued an official change duty orders (BUPERS order: 3028) with an obligated service of January 2024, a detaching date of June 2019, and a graduation of 17 July 2020. See enclosure (3). d. In accordance with reference (b) [17 December 2018], this NAVADMIN corrects policy for Combat Zone Tax Exclusion (CZTE) and Early Promote (EP) Sailors and announces revised selective reenlistment bonus (SRB) award levels and reenlistment policy for active component (AC) and full-time support (FTS) and supersedes reference (a). Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Reenlistment requests for the listed SRB award levels will be approved based on quota availability. SRB reenlistment requests for FTS are currently not being accepted. SRB reenlistment requests for AC must be submitted to Community Management Support Branch (BUPERS-328) via Officer Personnel Information System (OPINS) or Navy Standard Integrated Personnel System (NSIPS) 35 to 120 days in advance of the requested reenlistment date for the Sailor. Furthermore, a zone “C” SRB with an award level of 3.0 ($60,000 award ceiling) for the HM/L10A rate/NEC was authorized. e. On 16 January 2019, Petitioner signed an agreement to extend enlistment for 4 months with an EAOS of 19 March 2019/SEAOS of 19 July 2020 in order to incur sufficient obligated service to execute BUPERS order: 3028 under the Obliserve-To-Train. Petitioner was authorized an SRB to be paid upon graduating and reenlisting. See enclosure (4). f. On 3 June 2019, Petitioner transferred. See enclosure (5). g. On 17 June 2020, COMNAVPERSCOM notified PERSUPP DET NAVSTA that Petitioner’s SRB was rejected. See enclosure (6). h. On 9 July 2020, Petitioner reenlisted for 6 years. See enclosure (7). i. On 20 July 2020, Petitioner entered zone “D”. See enclosure (2). j. On 31 July 2020, Petitioner earned NEC L10A (Independent Duty Corpsman School). See enclosure (8). k. On 31 July 2020, Officer in Charge, Surface Warfare Medical Institute notified Military pay and Compensation Branch stated that in accordance with reference (a), the member was eligible to receive the Surface Force Independent Duty Corpsman (SFIDC) Selective Reenlistment Bonus (SRB) after completion of SFIDC "C" School at the scheduled graduation and Reenlistment date of July 17, 2020. The member had extended from March 21, 2020 to July 19, 2020 on an Obligation to Training (OTT) that entitled him a Zone C SRB award level 3.0 is class, SFIDC Class 19030, will now graduate on July 31, 2020, eleven days after his 14th year of service. Petitioner will reenlist prior to his new graduation date currently scheduled for July 31, 2020. He will graduate with the Navy Enlisted Classification (NEC) L10A with a grade point average of 90.86. Due to the circumstances out of the Sailor's control causing his delayed reenlistment, he should be considered entitled to a Zone C SRB as would have been awarded otherwise. See enclosure (NDOTRCD letter dated 31 July 2020). See enclosure (9). l. On 31 July 2020, Petitioner transferred, and arrived to 2nd Regiment, 2nd Marine Division on 28 August 2020 for duty. See enclosure (5). m. In accordance with enclosure (10), the Community Management Support Branch provided an advisory opinion concluding that the evidence proffered by Petitioner is insufficient to support the requested record change. The advisory opinion points out the following issue: “Recommend disapproval to award Tier 1, Zone C, HM/L1OA, 3.5 award level SRB. On the date of reenlistment, 9 July 2020, he did not have the SRB qualifying skillset of HM/Ll0A. The last day to reenlist in zone C was 19 July 2020. As of the date this advisory was written, skillset HM/LIOA is not reflecting in petitioner's record.” CONCLUSION Upon review and consideration of all the evidence of record, and notwithstanding the opinion expressed in enclosure (10), the Board finds the existence of an injustice warranting corrective action. The Board concluded that due to no fault of Petitioner the scheduled graduation date was delayed from 17 July 2020 to 31 July 2020, due to the National Pandemic and outbreak of the COVID-19 Virus. Petitioner crossed out of the Zone C on 20 July 2020, prior to earning his NEC, making him ineligible for SRB. RECOMMENDATION In view of the above, the board directs the following corrective action: Petitioner earned NEC L10A (Independent Duty Corpsman School) on 19 July 2020 vice 31 July 2020. Petitioner was discharged and reenlisted on 18/19 July 2020, vice on 8/9 July 2020 for a term of 6 years. Note: This change will entitle the member to a zone “C” SRB with an award level of 3.0 ($60,000 dollar award ceiling) for the HM/L10A rate/NEC. That a copy of this report of proceedings be filed in Petitioner’s naval record. 4. Pursuant to Section 6(c) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(c)) it is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
