Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish retroactive advancement to Logistics Specialist First Class (LS1)/E6 from the September 2018 (Cycle 240) Navy Wide Advancement Exam (NWAE). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 25 February 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. In accordance with reference (b), Early Promote promotion recommendation is converted to 4.0 performance mark average (PMA). Reference (c) directed to compute PMA using all E5 evaluations with an ending date that fell within 1 September 2015 to 31 August 2018 for E6 candidates. b. On 16 December 2012, Petitioner advanced to Logistics Specialist Second Class (LS2)/E5. c. Petitioner received an Early Promote, Detachment of Individual report from 18 December 2014 through 3 February 2016. d. Petitioner received an Early Promote, Periodic report from 16 March 2017 through 15 March 2018. e. Petitioner received an Early Promote, Detachment of Individual report from 16 March 2018 through 28 June 2018. f. Petitioner’s Exam Profile Data for September 2018 (Cycle 240) NWAE reflects PMA of 3.95 with a final multiple score of (FMS) 178.84. g. On 6 August 2020, Commander, Destroyer Squadron FIFTY notified Naval Education and Training Professional Development Center (N321) of Petitioner’s PMA being computed incorrectly for September 2018 (Cycle 240) NWAE. Additionally, the letter noted Petitioner and Command attempts to obtain missing evaluation report for the period of 4 February 2016 through 15 March 2017 and it was determined no report was submitted. h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board determined Petitioner’s PMA was calculated incorrectly for the September 2018 (Cycle 240) NWAE. In accordance with reference (b), Petitioner’s PMA for Cycle 240 was 114 (4.0), resulting in an FMS of 182.84; exceeding the minimum FMS required to advance to LS1. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s Examination Profile Information and Exam Status sheet from the September 2018 (Cycle 240) NWAE is modified to reflect PMA (Eval Avg) “114 (4.0)” vice “110 (3.95)”, and FMS of “182.84” vice “178.84”. Note: The Minimum Multiple Required was 179.70. Petitioner was advanced to LS2/E6 effective 16 June 2019 with a time in rate of 1 January 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
