Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish entitlement to Enlistment Bonus for College Credit (EBCC). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 4 March 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. In accordance with reference (b), active component recruits that enlisted in any rate/program, and shipped in the months of October through September of any fiscal year, with 96 or greater semester hours from a postsecondary accredited institution were eligible to receive $7,000 upon graduation from Recruit Training Command (RTC). b. On 2 January 2019, Petitioner enlisted in the U.S. Naval Reserve for a term of 8-years. NAVCRUIT 1133/52, Enlistment Guarantees – Annex “A” listed Air Traffic Controller (AC 5YO) Class “A” School Guarantee and Enlistment Bonus for RTC PFA (EBPFA) - $2,000 Bonus. c. On 10 June 2019, Petitioner’ transcript was certified as a true copy and reflected he earned 122 credit hours. d. Petitioner’s Active Duty Service Date is 26 August 2019 and he signed NAVCRUIT 1133/102, Enlistment Bonus Statement of Understanding on the same day, indicating eligibility to receive $8,000 EBCC. e. Petitioner completed Recruit Basic Military Training on 26 October 2019. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the criteria to receive an EBCC; however, because of administrative oversight, NAVPERS 1133/52, Enlistment Guarantees – Annex “A” did not outline eligibility for EBCC in accordance with reference (b), thereby impeding his ability to receive the EBCC. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s NAVCRUIT 1133/52, Enlistment Guarantees – Annex “A” to DD Form 4 dated 2 January 2019 is modified to reflect Option 3: Enlistment Bonus for College Credit (EBCC) - $7,000 Bonus. This change will entitle Petitioner to $7,000 EBCC upon graduation from Recruit Training Command. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
