Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board). Petitioner requested to correct his record to show that he reenlisted under the Selective Training and Reenlistment (STAR) program, and was eligible for and received a Selective Reenlistment Bonus (SRB) with an award level of 10.0. 2. The Board reviewed Petitioner’s allegations of error and injustice on 22 April 2021, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of her naval service records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 18 September 2017, Petitioner entered active duty for 4 years with an EAOS of 17 September 2021/SEAOS 17 September 2023. See enclosure (2). c. On 1 August 2019, Petitioner completed the NUC PROPR PLANT OP REACTOR CN and earning NEC N13O. See enclosure (2). d. On 21 November 2019, Petitioner arrived to the USS (SSN ) for duty. See enclosure (3). e. In accordance with reference (b) [2 December 2019], this NAVADMIN announces revised selective reenlistment bonus (SRB)award levels and reenlistment policy for Active Component (AC) and Full-Time Support (FTS), updates to the pay for performance pilot (a Sailor 2025 initiative) and changes to how future SRB award levels will be announced. Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Reenlistment requests for the listed SRB award levels will be approved based on quota availability. SRB reenlistment requests for FTS are currently not being accepted. SRB reenlistment requests for AC must be submitted to the Community Management Support Branch (BUPERS-328) via Officer Personnel Information System (OPINS) or Navy Standard Integrated Personnel System (NSIPS) 35 to 120 days in advance of the requested reenlistment date for the Sailor. Sailors must reenlist within 270-days of their end of active obligated service (EAOS), except in the following cases: a. Nuclear-trained Sailors, b. Sailors who must obligate service (OBLISERV) to execute a permanent change of station move will be allowed to reenlist early any time within 1 Calendar Year of the detachment month, but not later than the date of detachment from the last intermediate duty station. Finally, a zone “A” SRB with an award level of 10.0 ($100,000 award ceiling) for the ETN(SS)/N13O rate/NEC was authorized. f. On 18 February 2020, Petitioner signed a NAVPERS 1040/4 (Career waypoints application) requesting in-rate reenlistment. This request was approved by cognizant authority on 20 February 2020. See enclosure (4). g. On 18 February 2020, Petitioner signed a NPPSC 1160/1 (Command Career Request) requesting a reenlistment date of 1 April 2020 and SRB with an award level of 10.0. This request was approved by cognizant authority on 20 February 2020. See enclosure (5). h. On 20 February 2020, Petitioner signed a NAVPERS 1306/7 (Electronic Personnel Action Request) requesting a STAR reenlistment. This request was approved by cognizant authority on 20 February 2020. See enclosure (6). i. On 28 February 2020, Deputy Chief of Naval Personnel notified Petitioner that he was authorized immediate in-rate reenlistment in the Active Component (AC) with expiration date of June 2021. See enclosure (7). j. On 6 March 2020, COMNAVPERSCOM approved Petitioner’s STAR request. See enclosure (8). k. On 1 April 2020, COMANVPERSCOM approved Petitioner’s SRB with an award level of 8.0 was approved for a 6 year reenlistment effective 15 April 2020. See enclosure (9). l. In accordance with enclosure (10), the Community Management Support Branch provided an advisory opinion concluding that the evidence proffered by Petitioner is insufficient to support the requested record change. The advisory opinion points out the following issue: “An SRB precertification was submitted to BUPERS- for petitioner to execute a 6 year term reenlistment on 15 April 2020. The SRB was approved to receive a Tier 1, zone A, ETN/Nl30, 8.0 award level upon reenlisting for 6 years on 15 April 2020. Additionally, the reenlistment contract was to be designated as a STAR reenlistment and eligible for advancement to ETN2/E5 upon executing the reenlistment. An audit of OPINS revealed no evidence of a reenlistment contract for 15 April 2020 resulting in the SRB being cancelled. Petitioner did not provide any supporting documents showing he reenlisted on 15 April 2020 for 6 years. Per reference (d), the award level for skill set ETN/Nl30, zone A was 8.0 effective 12 April 2020. To receive the higher award level in accordance with reference (c) he would have had to reenlist prior to 12 April 2020.” CONCLUSION Upon review and consideration of all the evidence of record, and notwithstanding the opinion expressed in enclosure (10), the Board finds the existence of an injustice warranting corrective action. The Board concluded that on 28 February 2020, Petitioner was authorized immediate inrate reenlistment in the Active Component (AC). That on 6 March 2020, Petitioner’s STAR request was approved. That on 1 April 2020, Petitioner’s SRB with an award level of 8.0 was approved for a 6-year reenlistment effective 15 April 2020. Petitioner’s approval for SRB occurred after 12 March 2020, and he was given the lesser award level based on his approved reenlistment date; therefore, he did not reenlist. RECOMMENDATION In view of the above, the board directs the following corrective action: Petitioner reenlisted on 11 April 2020 for a term of 6 years. Note: This change will entitle the member to a zone “A” SRB with an award level of 10.0 ($100,000 dollar award ceiling) for the ETN(SS)/N13O rate/NEC. Remaining obligated service to 17 September 2021 will be deducted from SRB computation. Petitioner was advanced to Petty Officer Second Class effective 11 April 2020 vice 15 April 2020. (Note: Grade adjustment is based on the STAR program) That a copy of this report of proceedings be filed in Petitioner’s naval record. 4.
