Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner’s Active Duty Service Date (ADSD) reflect 14 September 2009. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 11 March 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), the ADSD is the actual or adjusted date from which the amount of active military service performed is calculated. The ADSD reflects all periods of active federal military service in commissioned officer, warrant officer, or enlisted status. c. On 28 April 2004, Petitioner enlisted for 8 years in the U.S. Naval Reserve, with 15 months of active duty after initial entry/skills training, two years in an active drilling status as a Selected Reserve and the remaining obligation in either the non-drilling Individual Ready Reserve, with a national service program, or any combination of these options. d. On 18 August 2004, Petitioner signed an agreement to extend enlistment for 12 months in order to meet the requirements for Enlistment Bonus. e. Petitioner was issued a DD Form 214 for the period of 18 August 2004 to 17 October 2006 for a total of 2 years, 2 months of active service. f. Petitioner was issued a DD Form 214 for the period of 11 July 2007 to 22 July 08 for a total of 1 year, 12 days of active service. g. On 22 January 2012, Petitioner reenlisted for 2 years in the Inactive U.S. Naval Reserve. h. On 31 January 2013, Petitioner reenlisted for 4 years, and was recalled to active duty or active duty for special work (ADSW). i. On 1 February 2013, Petitioner signed an evaluation report and counseling record for the period of 16 March 2012 to 30 January 2013 stating that he was selected from an outstanding field of applicants to convert from a Drilling Reservist and reenlist as a Full Time Support sailor. j. On 18 March 2013, Petitioner was issued official change duty orders (BUPERS order: 0773) detaching from from temporary duty – FFA with a departure date of March 2013, reporting not later than 20 April 2013 to for duty. k. On 10 April 2013, Petitioner transferred from . l. On 15 April 2013, Petitioner arrived to for duty. m. On 25 July 2015, Petitioner reenlisted for 6 years in the Active U.S. Naval Reserve. n. On 28 April 2018 (Anniversary date), Petitioner’s statement of service for Navy Reserve Retirement listed Annual Training (AT)/Active Duty for Training (ADT) of 61 days. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2) and reference (b), the Board finds the existence of an injustice warranting the following partial corrective action. The Board concluded that when Petitioner entered active duty on 31 January 2013, his ADBD was not updated correctly. Petitioner previously earned 3 years, 4 months, and 13 days of active service, establishing a new ADBD of 18 September 2009 vice 12 March 2012. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The immediate reenlistment contract (NAVPERS 1070/601) executed on 25 July 2015 for a term of 6 years listed an ADSD of 18 September 2009 vice 11 July 2007. That part of the Petitioner's request for corrective action that exceeds the foregoing be denied. During the review no additional active service was found. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
