Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to reflect appropriate award points for March 2019 (Cycle 243) Navy Wide Advancement Examination (NWAE) for advancement to First Class Petty Officer. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 17 December 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner advanced to AT2/E5 effective 16 July 2016. b. On 28 February 2019 the Commanding Officer, Navy Flight Demonstration Squadron signs the Navy and Marine Corps Achievement Medal (NMCAM) (Gold Star in Lieu of Second Award) certificate for the Petitioner’s achievement in the superior performance of duties during the period from October 2017 to February 2019. c. Petitioner’s exam profile for March 2019 (Cycle 243) NWAE for exam rate AT1/E6 USN reflects award points ‘2’, Final Multiple Score (FMS) ‘117.91’, Minimum Multiple Required ‘118.11’. d. Petitioner contends he was presented the NMCAM signed effective 28 February 2019 until 30 June 2020. e. On 4 August 2020 Chief of Naval Air Training command signs first endorsement on Exception to Policy Request for Petitioner. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that when the missing NMCAM is reflected in Petitioner’s Official Military Personnel File (OMPF) his request would have merit and warrant favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board determined the Petitioner was awarded a second NMCAM effective 28 February 2019 and that award is contained in the Petitioner’s OMPF. The Board concluded the Petitioner’s award points for the March 2019 (Cycle 243) should reflect ‘4’ vice ‘2’ and relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s award record reflects two (2) Navy and Marine Corps Achievement Medals awarded. Petitioner’s FMS recalculation for the March 2019 (Cycle 243) NWAE is: a. Exam Standard Score: 59.21 b. PMA: 56.10 (3.87) c. Service in Pay Grade: 0.60 (0300) d. Awards: 4.00 e. Education Points: 0.00 f. PNA: 0.00 g. FMS: 119.91 The minimum FMS required for advancement to AT1/E6 from March 2019 (Cycle 243) NWAE was 118.11. Petitioner advanced to AT1/E6 effective 16 December 2019 with a time in rate of 1 July 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
