Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was credited with career sea time previously earned and career sea pay (CSP) adjusted accordingly. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 6 April 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 26 January 2004, Petitioner entered active duty. During this period, Petitioner was assigned to the USS from 9 December 2004 to 25 January 2008. Petitioner was released from active duty and transferred to the Navy Reserve after completing of required active service on 25 January 2008. Petitioner’s DD Form 214 listed 3 years, 1 month, and 17 days of sea service. c. On 30 September 2015, Petitioner reenlisted in the inactive U.S. Naval Reserve for 4 years. d. On 15 January 2016, Petitioner entered active duty, and was released from active duty and transferred to the Navy Reserve after completing of required active service on 4 January 2017. Petitioner’s DD Form 214 listed 0 years, 0 months, and 0 days of sea service. e. On 9 January 2018, Petitioner reenlisted in the active U.S. Navy for 4 years. f. On 12 December 2018, Petitioner was assigned to the Furthermore, Petitioner began to receive Career Sea Pay. Currently, Petitioner’s sea duty counter reflects 889 days. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2) and reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that upon his return to active duty in 2018, due to administrative oversight, Petitioner’s Sea Duty Counter was reset. There’s evidence that Petitioner was not credited with career sea time for the time he was assigned to the during the period of 2004 to 2008 causing Petitioner to receive incorrect CSP. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s Sea Duty Counter was updated upon Petitioner’s return to active duty in 2018 in accordance with DD Form 214 effective 25 January 2008. Note: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
