Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner’s active duty enlistment date is 26 July 2001 on his Certificate of Release or Discharge (DD Form 214). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 11 March 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 11 December 2000, Petitioner enlisted for 8 years in the U.S. Naval Reserve. c. On 26 July 2001, Petitioner entered active duty for 4 years, and agreed to extend enlistment for 12 months (later cancelled due to disenrollment from class HM “A” school). d. On 30 October 2002, Petitioner entered an unauthorized absence (UA) status, and returned from UA on 17 November 2002 (18 days). e. On 19 November 2002, Petitioner entered a UA status, and returned from UA on 16 December 2002 (27 days). f. On 29 December 2002, Petitioner entered a UA status, and returned from UA on 24 January 2003 (26 days). g. In accordance with reference (b), Block 12a. DATE ENTERED ACTIVE DUTY THIS PERIOD. The date entered in Block 12a shall be the date of enlistment for the earliest period of continuous active service for which a DD 214 was not previously issued. Block 12c. NET ACTIVE SERVICE THIS PERIOD. Enter the years, months, and days of net service this period. (Do not include lost time in determining net active service.). Block 29. DATES OF TIME LOST DURING THIS PERIOD. Enter inclusive dates for all periods of time lost during this period of active duty, include periods of unauthorized absence or sickness due to misconduct, but do not identify types of time lost other than by “TL.” Examples: TL 99JUN21 TO 99JUN29 or TL - NONE h. On 30 July 2005, Petitioner was discharged due to misconduct – pattern of misconduct. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that blocks 12a, 12c, and 29 of DD Form 214 issued effective 30 July 2005 are incorrect. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The Certificate of Release or Discharge from Active duty (DD Form 214) executed on 30 July 2005 listed block 12a (Date entered AD this period) was “26 July 2001” vice “4 October 2001”, block 12c (Net active service this period) was “03 09 24” vice “03 09 11”, and block 29 (Dates of time lost during this period) was TL 20021030 TO 20021116; TL 20021119 TO 20021215; and TL 20021229 TO 20030123” vice “TL-20021030-20030124”. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy.
