Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to Sea Duty Incentive Pay-Extension (SDIP-E) from September 2019 to May 2020. 2. The Board, reviewed Petitioner’s allegations of error and injustice on 29 October 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of enclosures (1) through (10), relevant portions of Petitioner’s naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), SDIP-E applies to qualified Sailors that voluntarily extend onboard their current command when assigned to ships, submarines, or aviation squadrons designated as sea duty for rotational purposes, by a minimum of 12 months and a maximum of 48 months beyond their prescribed sea tour (PST). Additionally, personnel may not receive SDIP-E for any months prior to completing their PST or their current projected rotation date (PRD), whichever occurs later. Furthermore, the detailer must receive requests for SDIP-E 11 to 13 months prior to the PST completion date or PRD, whichever occurs later. c. Petitioner reported to on 28 February 2015. See enclosure (2). d. On 8 August 2018, Navy Personnel Command (PERS-406) informed Petitioner “cannot route a 1306 or SDIP until she is awarded the W16A”. See enclosure (3). e. On 4 September 2018, notified PERS-406 of intent to submit NAVPERS 1306/7, Electronic Personnel Action Request for Petitioner to extend onboard for 2-years using SDIP upon completing Air Intercept Controller (AIC) course. See enclosure (4). f. Petitioner completed AIC course on 11 December 2018 and awarded Navy Enlisted Classification code W16A. See enclosure (5). g. On 9 January 2019, Petitioner submitted NAVPERS 1306/7, Electronic Personnel Action Request “to extend onboard under the voluntary sea duty program from 1AUG19 to 1AUG21 (24 months) for SDIP purposes”. Commanding Officer approved the request on 17 January 2019. See enclosure (6). h. On 18 July 2019, Petitioner submitted NAVPERS 1306/7, Electronic Personnel Action Request “to extend projected rotation date (PRD) from 1909 to 2112 under SDIP-E”. Commanding Officer favorably endorsed the request on 19 July 2019. See enclosure (7). i. On 16 July 2019, Navy Personnel Command (PERS-406) informed the direction provided to submit Petitioner for SDIP after graduation was incorrect. However, at that point it is too late to back date SDIP and provided two courses of action; one of which was to submit BCNR application. See enclosure (8). j. On 9 September 2019, Petitioner reenlisted for a term of 2-years and record reflects a PRD of 1 December 2021. See enclosures (5). k. On 20 March 2020, Office of the Chief of Naval Operations (OPNAV N130) provided an unfavorable advisory opinion to enclosure (1). OPNAV N130 recommended disapproval of relief based on Petitioner not applying for SDIP-E 11 to 13 months prior to PRD. On 5 September 2020, Petitioner was provided the unfavorable advisory opinion for an opportunity to submit a statement or additional documentation; a reply was not received. See enclosures (9) and (10). BOARD CONCLUSION Upon review and consideration of all the evidence of record, the Board unanimously concluded Petitioner’s request warrants favorable corrective action. In this regard, the Board determined Navy Personnel Command (PERS-406) provided erroneous counsel to regarding Petitioner’s ability to apply for SDIP-E. Because the Command was misinformed, Petitioner failed to apply for SDIP-E within the prescribed timeframe outlined in reference (b). Petitioner executed requirements for SDIP-E by reenlisting for 2-years, and extending PRD onboard BOARD RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: SDIP-E request was submitted to cognizant authority 11-months prior to Petitioner’s PRD; it was approved. Petitioner, in coordination with her command completed the required SDIP-E NAVPERS 1070/613, Administrative Remarks in a timely manner and submitted it to Commander, Navy Personnel Command for inclusion in the Petitioner’s Official Military Personnel File. These changes will entitle Petitioner to SDIP-E effective 9 September 2019. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
