Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish Petitioner’s social security number from to . Additionally, Petitioner request upgrade of his characterization of service from other than honorable (OTH) to “hardship.” 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 17 March 2021, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, as well as applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although the enclosure was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner entered in the Marine Corps and began a period of active duty on 16 June 1976. On 25 August 1977, Petitioner was eligible but not recommended for promotion due to substandard performance. Petitioner commenced a period of unauthorized absence (UA) from 2 November 1977 to 6 August 1978. As a result of the foregoing, Petitioner submitted a request for a good of the service (GOS) discharge in lieu of trial by court martial. On 22 August 1978, the staff judge advocate (SJA) determined Petitioner’s GOS request for discharge to be sufficient in law and fact. On 24 August 1978, the discharge authority approved and directed Petitioner’s discharge. On 1 September 1978, Petitioner was discharge with an OTH characterization of service by reason of GOS. d. Petitioner was issued a Report of Separation from the Active Duty (DD Form 214) which incorrectly reflects the following social security number: . e. Petitioner provided a certified copy of his social security card which reflects the following social security number: . CONCLUSION: Upon review and consideration of all the evidence of record, the Board determined the Petitioner’s request warrants partial favorable action. The Board notes the Petitioner’s DD Form 214 incorrectly reflects his social security number. The Board notes that Petitioner has provided legal evidence which reflects his correct social security number. In regard to the Petitioner’s request for upgrade to his characterization of service, the Board determined the Petitioner was issued the appropriate characterization of service. In view of the above, the Board directs the following corrective action. RECOMMENDATION: That Petitioner’s naval record, be corrected to reflect the correct social security number: . That Petitioner be issued Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215) for period of active duty ending on 1 September 1978 to reflect Petitioner’s correct name social security number. That a copy of this Report of Proceedings be filed in Subject’s Naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
