Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to show Petitioner was eligible for and received Health Profession Officer (HPO) Incentive Pay (IP). 2. The Board, consisting of Mr. , Mr. , and Ms. , reviewed Petitioner’s allegations of error and injustice on 10 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), Department of the Navy policy is to administer those special pays supporting recruitment and retention of qualified physicians, dentists, medical service personnel, and nurses to meet authorized strength in approved medical and dental specialties. ISP is an award to Medical Corps officers intended to reduce the pay gap between military medical officers who meet specified criteria and civilian specialists. Eligible Medical Corps officers must submit requests for ISP to BUMED-M1C1 using the example provided in Appendix 2-J, via their CO. COs must endorse and forward all requests for ISP to BUMED-M1C1 with a recommendation dated within 30 days of the requested effective date and ensure that the effective date on the agreement has been verified to be correct following this instruction. Appendix 2-J provides the format for requesting approval and CO endorsement of an ISP agreement. COs must provide a detailed and specific explanation of the delay on all ISP requests not endorsed within 30 days of the requested effective date. BUMED-M1C1 may approve retroactive ISP agreements when the reason for delay in initiating the ISP agreement is clearly justifiable. c. On 26 July 2017, American Board of Medical Specialties issued Petitioner initial certification in Family Medicine – General with a reverification date of 15 February 2021. d. On 5 August 2017, Petitioner arrived to for duty. e. On 18 August 2017, Petitioner submitted an active duty request/agreement for Health Professions Officer Incentive Pay. Petitioner agreed to remain on continuous active duty for a period of not less than one year from 26 July 2017. Furthermore, Incentive Pay (IP) in the amount of $20,000 with an effective date of 26 July 2017, will be paid monthly, and may not be paid before approval of this agreement by Chief, BUMED. The specialty for which this IP is requested is General Medical Officer. f. On 25 August 2017, Commanding Officer, , endorsed/approved Petitioner’s request. The effective date of this agreement, and the dollar amount award, have been verified to be correct. Petitioner is licensed, privileged, and practicing in the specialty listed in paragraph 2.b of her request, and has met all requirements. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. There are emails in Petitioner’s application documenting the communication with her command Human Resources Department (HRD) in October 2017, and again April 2018, in an attempt to submit for the IP. The command HRD informed Petitioner they would provide her with the templates for the request, but there is no record the HRD sent any templates to her for submission. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner submitted an IP request in a timely manner, in accordance with OPNAVINST 7220.17. Furthermore, the request was received and approved by cognizant authority. Note: This change will entitle Petitioner to IP incentive, at the annual rate of $43,000 retroactive from 1 October 2018 through 30 September 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
