Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that the name on her Certificate of Release or Discharge from Active Duty (DD Form 214) be changed to reflect her legal name. Enclosures (1) and (2) apply. 2. The Board, consisting of, reviewed Petitioner’s allegations of error and injustice on 25 January 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken. Documentary material considered by the Board consisted of Petitioner’s application together with all material submitted in support thereof, relevant portions of Petitioner’s naval record, and applicable statutes, regulations, and policies, to include the 25 July 2018 guidance from the Under Secretary of Defense for Personnel and Readiness regarding equity, injustice or clemency determinations (Wilkie Memo). 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although the application was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner served on active duty in the Marine Corps from 23 September 1997 through 22 March 2002, when she received an honorable discharge upon completion of her required period of active duty service. d. Petitioner was issued a DD Form 214 that reflects her birth name of . Petitioner has legally changed her name from to . e. Petitioner provides a 13 January 2014 for the ordering a name change from . CONCLUSION: In accordance with the foregoing, the Board concludes that Petitioner’s DD Form 214 should be changed to reflect Petitioner’s legal name of as she has provided legal evidence to support her request. The Board noted that normally a DD Form 215 would be issued to correct the record, however, the Board concluded that a new and updated DD Form 214 is warranted to eliminate the possibilities of invasive questions. The Board further concluded that no other changes should be made to Petitioner’s record. In view of the above, the Board directs the following corrective action: RECOMMENDATION: That Petitioner be issued a new DD Form 214 which reflects the name . That no further changes be made to the record. That a copy of this report of proceedings be filed in Petitioner’s naval record, along with the previously issued DD Form 214 which reflects the name and the updated DD Form 214 which reflects the name 4.
