Pursuant to the references, Petitioner, a former enlisted member of the Navy, filed the enclosure with the Board for Correction of Naval Records (Board) requesting a change to his naval record, specifically, to correct the record to his correct his name and his date of birth on his Certificate of Release or Discharge from Active Duty (DD Form 214). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 10 February 2020, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, as well as applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. It is in the interest of justice to review the application on its merits. c. Petitioner served honorably in the Navy and was discharged in 1989. d. Petitioner was issued a Certificate of Release or Discharge from Active Duty (DD Form 214) that reflects that the name and a date of birth of . e. Petitioner immigrated to the United States from when he was a child, and enlisted with his stepfather’s last name of “ ” and the date of birth of . f. Petitioner would like to update his DD Form 214 to reflect his legal name of and his correct date of birth of . Petitioner provides a copy of his Social Security Card with the name “ - ” and his driver’s license from the State of , which reflects the name “ ” and the date of birth of . He also provided a certified copy of a State Superior Court order, lawfully changing his name as indicated above. CONCLUSION: In accordance with the foregoing, particularly in light of the supporting documents which include Petitioner’s Social Security Card, driver’s license and Court order, the Board concludes that Petitioner’s DD Form 214 should be changed to reflect Petitioner’s correct legal name of and his correct date of birth of . In this regard, the Board concluded that a new and updated DD Form 214 is warranted to ensure clarity on Petitioner’s discharge documents. In view of the above, the Board directs the following corrective action: RECOMMENDATION: That Petitioner be issued a new DD Form 214 which reflects the name of and the date of birth of That no further changes be made to the record. That upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received on 26 February 2019. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
