Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to reflect reenlistment and advancement under the provisions of the Selective Training and Reenlistment (STAR) program. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 27 April 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 7 July 2014, Petitioner enlisted in the U.S. Naval Reserve for a term of 8-years. NAVCRUIT 1133/52, Enlistment Guarantee – Annex “A” listed Electricians Mate (ME/5YO) Class “A” School Guarantee (T+X). b. Petitioner’s Active Duty Service Date is 9 December 2014. c. On 9 December 2014, Petitioner signed NAVPERS 1070/621, Agreement to Extend Enlistment for a term of 12-months. d. On 15 April 2019, Petitioner was issued BUPERS Order: 1059, Official Change Duty Orders. e. On 20 September 2019, Petitioner reenlisted for 3-years. f. On 4 November 2019, Petitioner detached . g. On 17 November 2019, Petitioner reported to for temporary duty. h. On 20 December 2019, Petitioner completed the Enlisted Navy Recruiting Orientation and earned the Navy Recruiter Canvasser/803R Navy Enlisted Classification (NEC). i. On 20 January 2020, Petitioner reported to j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the eligibility criteria for advancement under the STAR program in accordance with reference (b) and (c) and a Selective Reenlistment Bonus (SRB) with SRB Kicker per reference (d). However, STAR and SRB with Kicker request was not submitted to the cognizant authority before reenlisting, thereby rendering Petitioner ineligible for STAR reenlistment, advancement, SRB and SRB Kicker. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner executed NAVPERS 1070/601, Immediate Reenlistment Contract on 20 September 2019 for a term of “5-years” vice “3-years” under the provisions of the STAR program. Petitioner entitled to a Tier Three, Zone “A” SRB with an award level of 1.0 ($30,000 award ceiling) for the Electrician’s Mate (EM) rating. Remaining obligated service to 8 December 2019 will be deducted from SRB computation. Petitioner advanced to Electrician’s Mate Second Class Petty Officer (EM2) effective 20 December 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
