Docket No. 7000-20 Ref: Signature Date Dear : This is in reference to your application for correction of your naval record pursuant to Section 1552 of Title 10, United States Code. After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your applications on 5 August 2021. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your applications, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations, and policies. The Board carefully considered your request to backdate your date of rank in the grade of master sergeant to the date you would have received, if selected by the Fiscal Year (FY) 2019 Sergeant Major through Master Sergeant Promotion Selection Board. The Board considered your contention that you were not briefed properly before the promotion board because the draw case code “CW” (serving in an Expanded Permanent Limited Duty (EPLD)) had not been entered into the Marine Corps Total Force System prior to the FY 2019 promotion selection board. The Board noted that in December 2015, you received a letter from the Commandant of the Marine Corps (MMEA-1) assigning you to EPLD. Additionally, Section I comments in two fitness reports for the reporting periods 2 August 2016 to 30 June 2017 and 1 July 2017 to 30 June 2018, state that you were “[a]ssigned to Expanded Permanent Limited Duty . . .” The Board noted that the MMEA-1 letter and both fitness reports were in your official military personnel file, and available for consideration by the FY 2019 promotion selection board. The Board also noted that Headquarters Marine Corps Promotion Branch (MMPR-2) determined that you were properly considered by the FY 2019 promotion selection board, and noted that the enlisted promotion system has no medical prerequisites for promotion. The Board determined that your contention that your record was not properly briefed to the FY 2019 Sergeant Major through Master Sergeant Promotion Selection Board is speculation and is unsupported by the evidence before the Board. In view of the foregoing, the Board concluded that the requested relief is not warranted. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
