Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected by removing and replacing his 13 March 2017 to 15 March 2018 Evaluation Report & Counseling Record. 2. The Board, consisting of , , and , reviewed Petitioner’s allegations of error and injustice on 5 August 2021, and pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, found as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. Petitioner was issued enclosure (2), a Periodic/Regular Evaluation Report & Counseling Record for the reporting period 13 March 2017 to 15 March 2018. Petitioner contends that the Evaluation Report is not in compliance with reference (b) because Blocks 45 and 46 erroneously put him in a Summary Group of one. Petitioner also furnished enclosure (3), an Evaluation Report & Counseling Record for the same reporting occasion and reporting period with a purportedly correct Summary Group. c. The AO at enclosure (4), furnished by the Navy Personnel Command (PERS-32) noted that Blocks 45 and 46 of the contested Evaluation Report are erroneously marked. PERS-32 recommends the correct Evaluation Report at enclosure (3) replace the original Evaluation Report on file and that corrections be made to Petitioner’s performance summary report (PSR). CONCLUSION Upon review and consideration of all the evidence, the Board concluded that Petitioner’s request warrants relief. In this regard, the Board concurred with the AO in that the contested Evaluation Report at enclosure (2) is in error, and concluded that it shall be removed from Petitioner’s official military personnel file, and replaced with the Evaluation Report at enclosure (3). Furthermore, the Board concluded that Petitioner’s PSR shall be corrected to reflect the data from the Evaluation Report at enclosure (3). RECOMMENDATION In view of the above, the Board recommends the following corrective action. Petitioner naval record be corrected by removing enclosure (2), the Evaluation Report & Counseling Record for the reporting period 13 March 2017 to 15 March 2018, signed 16 March 2018. Petitioner naval record be corrected by inserting enclosure (3), the Evaluation Report & Counseling Record for the reporting period 13 March 2017 to 15 March 2018, signed 15 March 2018, and that Petitioner’s PSR be corrected to reflect the data contained in this Evaluation Report. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
