Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish entitlement to Enlistment Bonus for College Credit (EBCC) and Advanced Paygrade. 2. The Board, consisting of Ms. , Ms. , and Mr. , reviewed Petitioner’s allegations of error and injustice on 8 July 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. In accordance with reference (b), active component recruits that enlisted in any rate/program, and shipped in the months of October through September of any fiscal year, with 48-71 semester hours from a postsecondary accredited institution were eligible to receive $4,000 upon graduation from Recruit Training Command (RTC). Reference (c), authorized enlistment in paygrade E-3 for persons who satisfactorily completed 48 semester hours or 72 quarter hours of college credits. b. On 19 May 2020, Petitioner enlisted in the Naval Reserve for a term of 8-years of which 4-years is considered an active duty obligation. NAVCRUIT 1133/52, Enlistment Guarantees – Annex “A” listed Cryptologic Technician-Maintenance (CTM/AEF) Advance Electronic Field, Enlistment Bonus for RTC PFA (EBPFA) - $2,000 Bonus, and Enlistment Bonus for College Credit (EBCC) - $3,000 Bonus. At time of enlistment, Petitioner earned 54 semester hours from Harrisburg Area Community College; Fall 2018 - 17 semester hours, Winter 2018 - 1 semester hour, Spring 2019 - 15 semester hours, Fall 2019 - 9 semester hours, Winter 2019 - 3 semester hours, and Spring 2020 - 9 semester hours. c. Petitioner’s ADSD is 10 August 2020. d. Petitioner completed Recruit Basic Military Training on 13 October 2020. e. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board determined Petitioner met the criteria to enter active duty in paygrade E-3 and receive a $4,000 EBCC in accordance with references (b) and (c). However, because of administrative oversight, Petitioner’s enlistment documents reflect accession onto active duty in paygrade E-2 and NAVPERS 1133/52, Enlistment Guarantees – Annex “A” erroneously reflects $3,000 EBCC. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s NAVCRUIT 1133/52, Enlistment Guarantee - Annex “A” to DD Form 4 dated 19 May 2020 is modified to reflect Option 3: Enlistment Bonus for College Credit (EBCC) – “$4,000” vice “$3,000” Bonus. Petitioner’s enlistment documents (DD Form 4, Enlistment/Reenlistment Document and DD Form 1966, Record of Military Processing) dated 19 May 2020 are amended to reflect accession in pay grade “E-3” vice “E-2.” These changes will entitle Petitioner to pay and allowance in pay grade “E-3” effective 10 August 2020 (ADSD) and payment of “$4,000” vice “$3,000” EBCC upon graduation of RTC. Note: The change to the effective date of paygrade to E-3 may also have affected Petitioner's E-4 advancement opportunity. If Petitioner was eligible for, but did not take the E-4 Navy Wide Advancement Exam (NWAE) because the above change had not occurred, the following procedures will apply to remediate that missed opportunity. Petitioner should take the next available E-4 NWAE. Upon passing the examination, Petitioner should reapply to this Board for consideration of advancement to E-4 retroactive to the date, Petitioner would have been advanced on the "missed" examination cycle(s). Petitioner must submit a DD Form 149, with at least a copy of worksheet for the missed cycle(s), command endorsement/recommendation, and a copy of this letter. The Board will then determine whether the request will be approved. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
