Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received a Selective Retention Bonus (SRB) and an Early Reenlistment Kicker. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 6 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 14 December 2009, Petitioner entered active duty. c. On 23 October 2014, Petitioner reenlisted for 4 years and 2 months with an ECC of 22 December 2018 and an EAS of 22 June 2019. d. In accordance with reference (b) [30 January 2018], this message initiates the FY19 Headquarters Marine Corps (HQMC) Special Duty Assignment (SDA) Selection Team (HSST) screening process. HQMC aims to select and assign the most qualified and capable Marines to duties as Recruiter, Drill Instructor, and Marine Security Guard (MSG) Detachment Commander. e. On 12 February 2018, Petitioner signed a NAVMC 11537 (Reenlistment Extension Lateral Move (RELM) request for 36 months in order to obligate for MSG duty. Request was approved by cognizant authority on 20 March 2018. f. On 26 March 2018, Petitioner’s Careerist Active Duty SDA w/Reenlistment/HSST request was submitted, and was approved by HQMC on 4 January 2019. g. On 1 June 2018, Petitioner was promoted to Staff Sergeant/E-6 and was assigned PMOS 0639. h. In accordance with reference (c) [2 July 2018], this bulletin announces the SRB program and the BSSRB program authorized for FY19. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2018 are eligible for the FY19 SRB program. This will include any regular component first term or career Marine with an End of Current Contract (ECC) from 1 October 2018 to 30 September 2019. Marines in Zones A, B, and C who have submitted for a 48 month reenlistment between 5 July 2018 through 30 September 2018 with a PMOS that is listed in section(s) 3.m, 3.n, and 3.o, and are subsequently approved, will rate a 10,000 dollar Early Reenlistment Kicker in addition to the PMOS bonus amount listed in section(s) 3.m, 3.n, and 3.o. After September 30, 2018, this Early Reenlistment Kicker will expire. Zone B applies to those active component Marines with 6 to 10 years of active military service. Zone B PMOS bonus payments for Marines who reenlist for at least 48 months obligated service are authorized as listed below in dollars (bonuses for Marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.j). Furthermore, a zone “B” SRB for MOS 0639, E6 and above, which is capped at $30,000 for 48 months of additional obligated service. i. On 5 January 2019, Petitioner reenlisted for 4 years with an ECC of 4 January 2023 and EAS of 4 February 2023. j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that at the time Petitioner submitted his Careerist Active Duty SDA w/Reenlistment/HSST request, he was a Sergeant/E-5 holding a PMOS of 0631, and was not authorized an SRB. By the time Petitioner’s request was approved, he had been promoted to Staff sergeant, was assigned PMOS 0639, and MARADMIN 370/18 had been published, authorizing him an SRB and Early Reenlistment Kicker. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The agreement to extend enlistment (NAVMC 321A) operative on 5 January 2023, is null and void. Petitioner was discharged on 4 January 2019 and reenlisted on 5 January 2019 for a term of 4 years and 6 months vice 4 years. Note: This change will entitle the member to a zone “B” SRB for MOS 0639, which is capped at $30,000 for 48 months of additional obligated service. Remaining obligated service to 22 June 2019 will be deducted from SRB computation. Furthermore, Petitioner is entitled to a 10,000 dollar Early Reenlistment Kicker. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy. 6/25/2021 Deputy Director
