Pursuant to the provisions of the reference, Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected by removing his 15 November 2019 Evaluation Report Extension and to replace it with the 20 October 2020 Administrative Change Letter. 2. The Board, consisting of Ms. , Mr. , and Mr. reviewed Petitioner's allegations of error and injustice on 3 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board, however, made the following findings: a. Petitioner was issued a Detachment of Individual, Regular report for the reporting period 16 August 2018 to 10 October 2019. Enclosure (2). b. Enclosure (3), a letter of extension was entered into Petitioner’s record changing blocks 14 and 15 (Period of Report) to reflect from 16 November 2018 to 15 November 2019. The letter of extension also changed the report to Periodic and added comments to blocks 29, 41 and 43. c. Enclosure (4), a Report Administrative Change was furnished to replace enclosure (3). The Report Administrative Change corrected blocks 14 and 15 to reflect 16 November 2018 and 10 October 2019 to correct an administrative error in the original evaluation report. d. Petitioner contends that the letter of extension was submitted without his knowledge and is in error. Specifically, the block 14 (from date) is incorrect, changing the report to periodic is not authorized, and the block 29, 41 and 43 comments are not authorized and included the name of another sailor. e. The advisory opinion (AO) recommended that Petitioner’s request be granted in part. The AO noted that the letter of extension is not required and not authorized in Petitioner’s case. The AO determined that the letter of extension should be removed because it is unjustified, inaccurate, unnecessary, and duplicates data already in the detachment evaluation report. Additionally, the AO recommended that the letter of extension not be replaced with the administrative change letter. The AO also noted that Petitioner’s next scheduled evaluation report would provide continuity. Enclosure (5). CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an error warranting partial corrective action. The Board noted that the letter of extension contained errors and that Petitioner’s follow on evaluation report is on file in Petitioner’s record. The Board substantially concurred with the AO that Petitioner’s letter of extension is inaccurate and unjustified. Accordingly, the Board determined that Petitioner’s letter of extension should be removed, but should not be replaced with the administrative change letter. RECOMMENDATION In view of the above, the Board directs the following corrective action. Petitioner’s naval record be corrected by removing his 15 November 2019 Evaluation Report Extension. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
