Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to reflect an active duty obligation of 3-years vice 4-years. 2. The Board, consisting of determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 17 April 2018, Petitioner enlisted in the U.S. Naval Reserve for 8-years; 3-years Active Obligation and 5-years in the Reserve Component. NAVCRUIT 1133/53, Professional Apprenticeship Career Track (PACT) Program Enlistment Guarantees – Annex “A” reflects Petitioner enlisting into the U.S. Navy for an active duty period of 3-years with Surface/Seaman Processional Apprenticeship Career Track (PACT) Program Guarantee. b. Petitioner’s DD Form 1966, Record of Military Processing reflects Block 17.l (AD Obligation) 4-years and Block 18.e (AD/RC Obligation) 4-years. c. Petitioner’s Active Duty Service Date is 17 July 2018. Petitioner’s DD Form 4, Enlistment/Reenlistment Document reflects he was discharged from the Delayed Entry/Enlistment Program and enlisted in the Regular Component of the United States Navy for a period of 3-years. d. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board determined Petitioner enlisted for a term of 8-years with 3-years on active duty and 5-years in the Reserve Component. However, Petitioner’s DD Form 1966 and Navy Standard Integrated Personnel System reflect an erroneous active duty obligation of 4-years vice 3-years; therefore, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s DD Form 1966, Record of Military Processing dated 17 April 2018 is amended to reflect: Block 17.l (AD Obligation) “3-years” vice “4-years” and 18.e (AD/RC Obligation) “3-years” vice “4-years”. Petitioner’s End of Active Obligated Service is “16 July 2021” vice “16 July 2022”. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
