Pursuant to the provisions of reference (a), Subject, hereinafter referred to a Petitioner, filed enclosure (1) with the Board for Correction of Naval Record (Board), requesting that his naval record be corrected to establish entitlement to Zone “C” Selective Reenlistment Bonus (SRB). 2. The Board reviewed Petitioner’s allegations of error and injustice on 27 May 2021, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. In accordance with reference (b), to be eligible for aZone “C” SRB, Sailors must have completed 10 years but not more than 14 years of total active military service on the date of reenlistment. Reference (c), promulgated the ratings and/or Navy Enlisted Classification codes eligible for an SRB. b. Petitioner’s Active Duty Service Date is 15 September 2006. See enclosure (2). c. Petitioner reenlisted on 16 June 2016 for a term of 3-years and thereafter executed extensions totaling an aggregate of 17-months; End of Active Obligated Service: 15 November 2020. See enclosure (3). d. Petitioner assigned to from 27 October 2017 thorough 30 April 2021. See enclosure (4). e. Petitioner reenlisted on 21 October 2020 for a term of 6-years; EAOS: 20 October 2026. At the time of reenlistment, Commanding Officer, wrote a letter indicating the ship had limited services onboard the ship, which resulted in the Petitioner reenlisting outside of zone to be eligible for an SRB. See enclosures (3) and (5). f. On 2 November 2020, Bureau of Naval Personnel (BUPERS-328) provided an unfavorable advisory opinion to enclosure (1). BUPERS-328 recommended disapproval of relief based on Petitioner’s length in service surpassingthe period to be eligible for a Zone “C” SRB in accordance with reference (b); at the time of reenlistment, Petitioner completed 14-years, 1-month and 6 days of active military service. See enclosure (6). g. On 18 November 2020, BCNR forwarded BUPERS- advisory opinion to the Petitioner for his review and response. Petitioner did not provide a response. See enclosure (7). BOARD CONCLUSION Upon review and consideration of all the evidence of record, and notwithstanding the comments provided in the advisory opinion, the Board concluded Petitioner’s request warrants favorable action. In this regard, the Board heavily relied on enclosure (5), whereby Petitioner’s Commanding Officer explained the ship experienced a time when they were unable to execute external communication, thereby causing Petitioner to reenlist outside of the Zone “C” SRB timeframe; thus rendering him ineligible. BOARD RECOMMENDATION In view of the above, the board directs the following corrective action: Petitioner’s NAVPERS 1070/601, Immediate Reenlistment Contract dated 21 October 2020 for a term of 6-years is amended to reflect reenlisting on “14 September 2020” vice “21 October 2020”. This change will entitle the Petitioner to a Zone “C” SRB with an award level of 1.5 ($45,000 award ceiling) for the Yeoman Submarine (YNSS) rating. Remaining obligated service to 15 November 2020 will be deducted from SRB computation. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
