The Board, consisting of Mr. Mr. and Mr. , reviewed Petitioner’s allegations of error and injustice on 29 April 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3.The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 30 January 1981, Petitioner enlisted in the U.S. Marine Corps Reserve, Delayed Entry Program for 6 years with a 3-year obligation in the Regular component and entered active duty effective 24 February 1981. b. On 28 November 1983, Petitioner released from active duty for immediate reenlistment. Petitioner issued DD Form 214, Certificate of Release or Discharge from Active Duty for period of active duty from 24 February 1981 through 28 November 1983. c. On 29 November 1983, Petitioner reenlist in U.S. Marine Corps (USMC) for 6 years. d. On 11 January 1989, Petitioner reenlist in USMC for 4 years. Petitioner should have received DD Form 214, Certificate of Release or Discharge from Active Duty from 29 November 1983 through 10 January 1989 in accordance with reference (b), however his Official Military Personnel File does not contain a copy. e. On 27 June 1989, reference (c) promulgated removing the requirement to issue Marines DD Form 214, Certificate of Release or Discharge from Active Duty for the purpose of immediate reenlistment. f. On 1 March 1993, Petitioner reenlisted in USMC for 4 years. g. On 5 February 1997, Petitioner reenlisted in USMC for 4 years. h. On 28 February 2001, Petitioner transferred to the Fleet Marine Corps Reserve. DD Form 214, Certificate of Release or Discharge from Active Duty does not account for active duty service from 11 January 1989 through 4 February 1997. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of errors warranting corrective action. The Board concluded there is no evidence Petitioner was issued DD Form 214, Certificate of Release or Discharge from Active Duty upon reenlisting on 11 January 1989 in accordance with reference (b). Additionally, per reference (d), the DD Form 214, Certificate of Release or Discharge from Active Duty dated 28 February 2001 does not reflect the accurate period of active duty service. Therefore, the Board felt, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner issued DD Form 214, Certificate of Release or Discharge from Active Duty for period of service from 29 November 1983 through 10 January 1989. Petitioner DD Form 214, Certificate of Release or Discharge from Active Duty dated 28 February 2001 is amended to reflect Block 12a (Date Entered AD this Period) “1989 01 11” vice “1997 02 05”; Block 12c (Net Active Service this Period) “12 01 18” vice “04 00 23”; Block 12d (Total Prior Active Service) “07 10 17” vice “16 01 07”. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
