Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received Special Duty Assignments Pay (SDAP) for the duration of his tenure at 4TH Reconnaissance Battalion. 2. The Board, consisting of Ms. Mr. , and Mr. , reviewed Petitioner’s allegations of error and injustice on 3 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. d. In accordance with reference (b), Special Duty Assignment Pay (SDAP) is awarded to Service members for the performance of duty in an assignment, location, or unit designated, where the assigned duties are determined to be extremely demanding, involving an unusual degree of responsibility or difficulty, or requiring special qualifications. c. On 19 October 2010, Petitioner graduated from USMC COMBATANT DIVER and earned Navy Enlisted Classifications (NEC) L11A (8427). d. Petitioner was issued official change duty orders (BUPERS order: 0317) with an EDD of April 2017. Furthermore, Petitioner was directed to an ultimate activity for duty at Albuquerque, NM with an EDA of 14 May 2017. e. On 14 May 2017, Petitioner arrived to DET 2 4TH RECON for duty. f. On 1 August 2020, Petitioner tranferred from duty station. g. Commanding Officer, 4TH Reconnaissance Battalion, notified Director, Personnel Support Detachment that the following member(s) are eligible to receive special duty assignment pay. Subject member is authorized Special Duty Assignment Pay (SDAP) at award level 2 (SD-2-150) based on Navy Enlisted Classification code 8427/L11A effective 14 May 2017. h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner was occupying a valid SDAP billet on the command’s manpower authorization document; however, due administrative oversight Petitioner failed to receive SDAP. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was entitled to SDAP while assigned as , onboard Det. 2, 4th Recon (UIC 45372), from to at SDAP level SD-2 at the rate of $150.00 per month. Note: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
