Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to reflect reporting to US Military Group Guatemala for duty on 18 November 2019 vice 26 November 2019. Additionally, Petitioner requested the associated travel, pay and allowances. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 6 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 7 October 2019, Petitioner issued Active Duty for Special Works (ADSW) orders modification. Petitioner ordered to report for ADSW from 16 November 2019 to 30 September 2020. Orders are identified as Permanent Change of Station (PCS) orders with the following instructions: Depart place from which called (or ordered) to Active Duty (PLEAD) no earlier than 16 November 2019. Ordered to report on or about 18 November 2019 to . Petitioner home address (PLEAD) on orders is located in . b. In accordance with reference (b), Petitioner was activated to ADSW effective 18 November 2019 and was performing duties for the Office of Security Cooperation, by arranging travel with and the travel office in in addition to completing required country and theater clearance requirements. c. On 23 November 2019, Petitioner departed and arrived to on same day. Petitioner checked into for temporary lodging. d. On 26 November 2019, Petitioner’s ADSW orders are endorsed effective this date and all pay and allowances begin this date. e. On 3 December 2019, Petitioner checked-out of . f. On 17 December 2019, Petitioner submitted claim for Temporary Lodging Allowance (TLA) for the period of 23 November 2019 through 2 December 2019. Petitioner’s supervisor certified Petitioner was required to reside in temporary lodging for the period indicated. g. On 30 July 2020, Petitioner submitted claim for TLA for the period of 23 November 2019 through 25 November 2019. Petitioner’s supervisor certified Petitioner was required to reside in temporary lodging for the period indicated. h. On 30 September 2020, Petitioner released from active duty and issued DD Form 214, Certificate of Release or Discharge from Active Duty; Block 12a (Date entered AD this Period) 23 November 2019. i. On 27 October 2020 after several email communications beginning on 3 June 2020 Petitioner is informed by Personnel Support Detachment (PSD), that she will have to petition Board for Correction of Naval Records to amend the active duty start date. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. The Board concluded due to administrative error made on Petitioner’s orders endorsement and administrative representative refusal to make appropriate corrections, Petitioner active duty begin date is in error; pay and allowances were not started on appropriate date and PCS travel entitlements/allowances were not paid or approved per references (c) through (e). RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner executed ADSW orders (DTG 070413Z Oct 19) with check-in endorsement on “18 November 2019” vice “26 November 2019”. Note: This change will entitle Petitioner to pay and allowances effective “18 November 2019” vice “26 November 2019”. Petitioner DD Form 214, Certificate of Release or Discharge from Active Duty dated 30 September 2020 is amended to reflect: Block 12a (Date Entered AD this Period) “2019 11 18” vice “2019 11 23”; Block 12c (Net Active Services this Period) “00 10 13” vice “00 10 08”. Petitioner must submit supplemental travel and TLA claim with a copy of this BCNR decision letter to PSD, for adjudication. Settlement of claims is chargeable to the line of accounting on Petitioner’s ADSW orders (DTG 070413Z Oct 19). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
