Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to validate March 2019 (Cycle 243) Navy Wide Advancement Exam (NWAE) and advancement to LSS3/E-4. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 21 January 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 8 August 2017, Petitioner entered active duty in the rank of E-3. b. On 23 March 2018, Petitioner was dis-enrolled from Nuclear Power School and reduced to E-1. c. On 16 February 2019, Petitioner was advanced to LSSN/E-3. d. In March 2019, Petitioner participated in Cycle 243 NWAE; however, the exam was invalidated as a result of not meeting the necessary time in grade in accordance with reference (b). e. On 30 April 2019, Petitioner’s BCNR Docket Number 4224-18 was approved and changed Petitioner’s LSSSN/E-3 date of rank to 8 August 2017; making Petitioner eligible to participate in the March 2019 (Cycle 243) NWAE. f. In September 2019, Petitioner participated in Cycle 244 NWAE and advanced to LSS3/E-4 effective 16 June 2020. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the eligibility criteria to participate in the March 2019 (Cycle 243) NWAE per reference (b) upon his record being corrected to reflect obtaining Eagle Scout Certification prior to enlistment, thereby meeting the criteria to maintain E-3 paygrade upon being disenrolled from the Nuclear Field Program. The Board determined Petitioner exceeded the minimum multiple score required to be advanced to LSS3/E-4 from the March 2019 (Cycle 243) NWAE; therefore, under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's Examination Profile Information and Exam Status sheet from the March 2019 (Cycle 243) NWAE is validated. Petitioner’s Final Multiple Score (FMS) for Cycle 243 equaled 104.97; exceeding the minimum FMS required of 82.10 to be advanced to LSS3/E-4. Petitioner was advanced to LSS3/E-4 effective “16 November 2019” vice “16 June 2020” with a time in rate date of “1 July 2019” vice “1 January 2020”. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
