Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting a change to his naval record to show he honorable served from 10 November 1983 to 9 November 1987 on his Certificate of Release or Discharge from Active Duty (DD Form 214). Enclosures (1) through (3) apply. 2.The Board consisting of reviewed Petitioner’s allegations of error and injustice on 24 February 2021 and, pursuant to its regulations determined that the corrective action indicated below should be taken. Documentary material considered by the Board consisted of Petitioner’sapplication together with all material submitted in supportthereof, relevant portions of Petitioner’s naval record, and applicable statutes, regulations, and policies, to include the 25 July 2018 guidance from the Under Secretary of Defense for Personnel and Readiness regarding equity, injustice or clemency determinations (Wilkie Memo). 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to waive the statute limitation and review the application on its merits. c. Petitioner began his first period of active duty on 12 February 1980. His final reenlistment occurred on 1 February 1988 and he was discharged on 28 November 1989, with an other than honorable (OTH) characterization of service by reason of misconduct due to minor disciplinary infractions. On 6 April 2001, the Naval Discharge Review Board discerned both impropriety and inequity in the characterization of the Petitioner’s service, and voted to change Petitioner’s OTH characterization of service to Honorable. During the review of Petitioner’s record, NDRB also noted an administrative error on Petitioner’s original DD Form 214 in that the Block 18, Remarks, should have contained the following statement: “Continuous Honorable Active Service from 10 NOV83 to 9 NOV87.” NDRB directed that the original DD214 should be corrected or reissued. However, the recommended correction was omitted from the new DD Form 214. CONCLUSION: Upon review and consideration of all the evidence of record, the Board concludes that Petitioner’s request warrants favorable action. The Board notes Petitioner’s naval records support his request, and as such, his record school be corrected to reflect his honorable period of service from “10 November 1983 to 9 November 1987” in item 18 on his DD Form 214. In accordance with the foregoing, the Board concluded that the record should be corrected by the issuance of a Correction to Certificate of Release or Discharge from Active Duty (DD Form 215), and the Petitioner be issued the same. In view of the foregoing, the Board recommends the following corrective action RECOMMENDATION: That Petitioner’s naval record is corrected to reflect that he has an honorable period of service from “10 November 1983 to 9 November 1987” in item 18 on his DD Form 214. That Petitioner is issued a DD Form 215. That no further changes be made to the record. 4.It is certified that a quorum was present at the Board’s review and deliberations, and that theforegoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of theBoard for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)) andhaving assured compliance with its provisions, it is hereby announced that the foregoingcorrective action, taken under the authority of reference (a), has been approved by the Board onbehalf of the Secretary of the Navy.
