Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish Petitioner’s awards points for the August 2019 (Cycle 105) Navy Wide Advancement Examination (NWAE) as “6” vice “5” and recalculate the Final Multiple Score (FMS). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 27 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner’s individual profile data for the August 2019 (Cycle 105) reflects awards points (5), FMS 113.60 with a minimum FMS required for advancement to HT1 of 114.11. Petitioner passed not advanced (PNA). b. Petitioner selected for advancement to HT1 from the February 2020 (Cycle 106) NWAE. c. On 5 February 2020 Petitioner awarded the Navy and Marine Corps Achievement Medal for professional achievement during the period of November 2019 to August 2019. d. On 16 August 2020 Petitioner advanced to HT1 E6 effective this date. e. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded per reference (b) Petitioner earned Navy and Marine Corps Achievement Medal prior to the day of the regularly scheduled NWAE, however, it was not properly processed for awarding and entry into his service record due to unforeseen circumstances warranting relief. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s award points on individual profile date was “6” vice “5” with a FMS of “114.60” vice “113.60”. Petitioner selected for advancement to HT1 with effective date of 16 June 2020. Petitioner’s advancement to HT1 effective 16 August 2020 rescinded. Petitioner advanced to HT1 E6 effective 16 June 2020 with a time in rate date of 1 January 2020. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
