Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to reflect satisfactory years of service for anniversary years ending 26 May 2019 and 26 May 2020. 2. The Board, consisting of Mr. Ms. , and Mr. , reviewed Petitioner’s allegations of error and injustice on 13 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 29 June 2001, Petitioner entered the United States Naval Academy (USNA). b. On 26 May 2005, Petitioner graduated from the USNA. c. On 27 May 2005, Petitioner was commissioned in the United States Marine Corps. d. On 7 May 2016, Petitioner was released from active duty. e. On 8 May 2016, Petitioner was assigned to the Individual Ready Reserve. f. On 6 June 2017, Petitioner transferred to Individual Mobilization Augmentee status. g. On 16 June 2020, Installation Personnel Administrative Center, Marine Forces Reserve, notifies Petitioner of anniversary year correction. h. On 12 May 2021, Petitioner’s Career Retirement Credit Report pulled from Marine Corps Total Force System reflects anniversary year ending 26 May 2019 as unsatisfactory and anniversary year ending 26 May 2020 as satisfactory with 65 total points credited. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and recommended 21-non paid drills be added to the anniversary year ending May 2019. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. Petitioner’s anniversary year was erroneously started on 29 June. However, in accordance with reference (b), time served in a Service academy is not creditable for pay purposes. Upon the Marine Corps correcting the anniversary date to 27 May, Petitioner’s points were redistributed. The redistributed points resulted in Petitioner not having the minimum 50 points for a satisfactory year for anniversary year ending 26 May 2019. The Board felt, under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was awarded 21 non-paid inactive duty training periods. Note: This change will result in a satisfactory year of service for anniversary year ending 26 May 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
