Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received Health Profession Officer (HPO) Board Certification Pay (BCP). 2. The Board, consisting of Mr. , Mr. , and Ms. , reviewed Petitioner’s allegations of error and injustice on 10 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), Department of the Navy policy is to administer those special pays supporting recruitment and retention of qualified physicians, dentists, medical service personnel, and nurses to meet authorized strength in approved medical and dental specialties. BCP is an entitlement for Medical Corps officers who are board certified in a medical specialty recognized by the American Board of Medical Specialties (ABMS) or the Bureau for Osteopathic Specialists. Entitlement to BCP is effective on the date of commencement of active duty, or the date the officer becomes board certified in the specialty, whichever is later. To receive BCP, an officer must submit a request, via the Commanding Officer (CO), to Chief, Bureau of Medicine and Surgery (BUMED-M1C1), with a copy of the board certificate or a copy of the board’s letter of notification of certification. The certificate or board letter must contain the start and end date of certification. BCP will be paid monthly at the annual rates listed in Appendix 2-H. c. Petitioner’s Pay Entry Base Date is 25 October 1989, and Health Professional Pay Entry Date of 16 May 1992. d. On 19 January 2002, American Board of Preventive Medicine issued Petitioner initial certification in Public Health and General Preventive Medicine with an expiration date of 31 July 2012. e. On 3 July 2007, Petitioner arrived to for duty. f. On 27 August 2012, Petitioner was recertified with an expiration date of 31 August 2022. g. On 29 August 2013, Petitioner transferred. On 29 August 2013, Petitioner arrived to for duty, and transferred on 6 July 2016. On 20 July 2016, Petitioner arrived to for duty, and retired on 30 November 2019. h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that as a result of a lapse in certification, per reference (b), Petitioner was required to resubmit a request for BCP with documentation supporting board certification, which never reached BUMED. Petitioner was eligible for BCP based on the recertification date of 27 August 2012. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner submitted a BCP request in a timely manner, in accordance with OPNAVINST 7220.17. Furthermore, the request was received and approved by cognizant authority. Note: This change will entitle Petitioner to a BCP incentive, at the annual rate of $6,000 retroactive from 27 August 2012 through 30 June 2017. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy. 10/5/2021 Deputy Director
